  • How can i prove that i have been framed (set up) in work

    Recently i have been framed at work and attend an disciplinary hearing on friday im not allowed in work to gather my evidence and im not allowed to contact work colleagues to help with my evidence. Any suggestions please.

      hi its viking warrior here, a person who remains unknown made a statement about me on the company blog which is untrue, secondly the company i work for has the area managers wife trying to get rid of me since june 2014 she sees this as her golden opportunity and adds to this event by sending up her area supervisor to meet and talk with me. After our talk she asked if she could say hello to the director in charge of me he said send her over. She then became an actress and convinced him that i had said bad things about the area manager and his wife non of this is true and im fighting for my life my credability and most of all the job that i love doing. Im being attacked on all fronts can someone please help.thankyou.

        Is this area managers wife an employee of the same company?
        Who is the AM's line superior?
        Are the alleged remarks defamatory?
        Is there an HR department that you can complain to and put your side of this saga?

          The area managers wife is anemployee of the same company and has rank. I have with the advice of acas put in a grievance against the area manager and his wife through the company hr office all will be heard on friday wish me luck i need it.

            Does your company have an IT department of IT engineer. as the person who made the comment on the company blog about you could be traced by the IP address of the computer/laptop used to submit the comment on the blog!!

                I would like to thank everyone who gave me advice i am a new member and i must admit after joining i feel as if i am part of a family who i can turn to for help even though the members helping me are strangers.here is an update the disciplinary was held on friday at 9.30 am i was put at ease by the person conducting the disciplinary. He said that the person who put accusations on the company voice box had a grudge to bind and therefore no evidence has come forward so in the bin it goes. I am waiting for a decision to be made on wether i can return to work, i will keep you informed, once again thankyou al for your kindly advice and good wishes.

                  If that is what the person conducting your disciplinary had said about the person making the accusation. Then once you have been allowed to return to work, you should issue a formal grievance against your accuser, for harassment and making untrue, libelous statements about you for the sole purpose of getting you in to trouble at work with the hope you would have been dismissed. Remind the company they have a duty of care under the employment contract as well as under employment law to protect you and all employees from being harassed/bullied by other employees. Also remind them that harassment and/or bullying in the workplace is an act of gross misconduct and you expect it to be treated as such as part of their contractual and legal duty of care towards you - State clearly the a breach of their contractual or legal duty of care towards your, to protect your from harassment and/or bullying, is a serious breach of contract/legalisation and gives your grounds to take employment tribunal action!

                  By issuing a formal grienvance, the company will have to carry out a full grievance procedure and even take disciplinary action against your accuser. Which will require that you attend a grievance hearing, but don't worry as its just standard procedure to get your side of the story and gather evidence against the person you issued the grievance against.

                        Thankyou for all your advice but on 24/04 2015 i was dismissed from my job even though i was innocent it seemed to me that the cleaning company protect their own and made me look bad so i will not appeal on the grounds that the disciplanary procedure was a foregone conclusion on the cleaning companys part and i was set up because i told the truth. Thankyou everyone for your advice but i never stood a chance.

                          Sorry to hear that. Personally i would appeal, and point out what the person in the disciplinary hearing had said, and that they had not carried out a proper investigation as simply tracing the computer used and matching the CCTV in the canteen to the date and time the offensive material was posted on the blog would show who was responsible.

                          What evidence did they have to even suspect it was you?

                            Hi teaboy 2 i understand where you are coming from but trust me its better to move on and be away from the four people that framed me they did a good job. I will be alot happier and more wiser for the experience . Once again thankyou for your help and thanks to the other members of legal beagles im now part of a family and that means more to me than getting my job back.
