  • CHILDABDUCTION,Harrasment, Mental Health

3 weeks after having our second child my wifes father passed away, she left the UK to attend his funeral in Pakistan leaving me to look after our baby. She then had problem with her visa resulting in myslef obtaining a passport for my son and re-uniting mother and child until visa issue wassorted out and she could return to UK.

This is when problems started...over the course of the next 5 years we had numerous arguements often resulting in her calling the police. The police would attend and ask me to leave the property, she would then call me back. I am the primary carer for both children and my wife I also work full-time. Her behaviour was described as odd by the school headteacher and social services were involved after a long time we actually realised that my wife is suffering from some sort of mental illness hence the cause of all the arguements we used to have...it wasn't that she was being awkward but she was ill.
    ..
for the last 5 years myself and my wife and kids have been harrassed by my in-laws They have caused numerous arguments in our marriage and resulted in my wife being sectioned. She is undergoing treatment under section 2 and the last 4 weeks doing well until today when her sister and husband turned up causing her to be stressed and now she is on a section 3.

There have been threats made to remove my children from the uk and also by manipulating my wife emotionaly due to her mental illness they are placing pressure on her to leave and emigrate abroad. They know they cant make UK passports but are preparing to make pakistan passports so the children will travel with those.

How and who do I contact to prevent issueing of pakistani passport and visa's for my children?
    What can I do to safe-guard my children aged 7 & 5?
How can i prevent them from harassing my wife myself and my children?
Is there any kind of injunction and what are the costs?
Do i qualify for legal aid as i am working full time and earn £20k?

    Hi Nasxtra and welcome,

Please have a look at this website and follow their advice: http://www.pact-online.org/child-abduction-prevention/

    If the risk is imminent:
    • Contact a specialist lawyer. A list of specialist lawyers can be found on the website for the International Child Abduction and Contact Unit [https://www.justice.gov.uk/protectin...d-contact-unit].
    • Get an urgent without notice application to the Applications Judge sitting in the Family Division of the Royal Courts of Justice. (The Applications Judge sits all day, Mondays to Fridays. Applications can be made at 10.30am and 2pm. ‘Out of hours’ emergency applications can also be made)
    • Obtain a ‘Port Alert’ and a ‘Tipstaff order’. A Port Alert will put a warning on the borders so that your child will be stopped by the authorities if someone tries to take the child across a border. A Tipstaff order will allow the police to go round to the proposed abductor’s house and take away all passports and travel documents in respect of them and your child.
    • The application to the court should be your first port of call.
    • Then go to your local police and ask them to circulate an “All Ports Warning” and put your child on the ‘child abduction list’.
    • If your local police are not responsive, insist on speaking to a Senior Officer. Do not just rely on the police to act.
