  • Maternity policy not transferred under TUPE?

    We were transferred from company A to company B just over 2 years ago. We were always under the impression that our enhanced Maternity pay and Redundancy carried over with us however I have recently been checking with company B for confirmation of the length of this increased payment as Company A's is considerably longer than Company B (100% for 6 months compared to 6 weeks) and they have advised that this is not contractual term but rather a Company held policy like bonuses and therefore I am not entitled to the enhanced payment. The maternity policy was always in our staff handbook online and upon checking tonight neither maternity or redundancy are mentioned in our contract, however we had assumed that these were carried over the same as sickness and holidays (these are both in the contract). When we transferred company A gave us a Q&A document which had "What is included when providing Terms and Conditions to a 3rd party" and listed Hours of work, salary ranges, incentive, holiday, sick pay, maternity and redundancy terms"

    Sorry if that sounds a bit long winded, just wondered if anyone could advise if we have any comeback on this?
