  • Social workers fabricated evidence and submitted it to the High Court.

    Last Thursday during a Judicial Review in the High Court Social workers made false allegations against my wife and I. These allegations were made after we reported the social workers for covering up child abuse allegations we had made about a child who was previously in our care. Since Thursday I have tracked the Clinical nurse who had allegedly made the allegations and she has written a statement emphatically denying ever making the allegations. In fact she is on the record as stating she informed the social workers that the allegations were completely wrong. As a result of the social workers lies we are unable to work and are about to have our family home repossessed. How do I bring this perjury to the attention of the Judge?

    Is there a formal procedure we have to follow?

    We were unable to afford legal representation as we are both full time foster carers have have been suspended for nearly a year without any pay then dismissed. Any help or advice will be gratefully received.

      Were you present at the Judicial Review and were you a party to it? (ie did you hear first hand the allegations made and did you have opportunity to dispute ? )


      To appeal a JR decision you really should get legal rep to assist.

        Is the allegations in the written notes of the social workers which were within reports that the council have?

        My personal opinion is contact this group, which although they are a campaign group for families, might have an interest in this, if you have a sworn written statement to the fact that social workers deliberately suppressed information relating to the abuse of a child.

        I would further add that if they have made written reports which clearly state that the clinical nurse said one thing which was wrong then you should pursue a formal complaint to their professional body: http://www.hpc-uk.org/complaints/

        I would perhaps suggest that you also write to the chief executive of your local council with a formal complaint.

        Did they testify in court to the fact that they saw something? If they have simply submitted a report to the court that has said that x person did certain things then perhaps even approaching the press might be an option.

          There is rarely oral evidence in JR proceedings.

          From my reading of OP, they are saying that the SW suggested that the nurse made allegations which the nurse themselves say they didn't make. I don't think anyone is suggesting that the nurse did anything wrong.

          With respect, if it has got as far as JR proceedings it has gone beyond the point at which it is worth complaining to the chief exec.

          OP - who was applying for what in the JR - what decision was being reviewed and on whose application?

          Did it fail at the permission stage or was there a substantive hearing?

          If a substantive hearing then appeal is to the Court of Appeal which is well beyond the capability of most litigants in person (and many lawyers for that matter) - in 20odd years I have only ever had one case go to the Court of Appeal (I lost!)
