    Hello all,

    It has been a while, and I wonder if any of you might be able to give me some advise again please?

    just a brief timeframe, I defaulted on an o2 phone contract in roughly 2004.

    I have been chased for this debt for years by several different dca's. over past few years it has been lowell chasing on and off.

    Just recently after hearing nothing from lowell regarding this debt for the best part of a year I have recieved a letter from them stating that as I have not made payment my account has now been passed to rossendales collection Ltd. They also enclosed a letter from rossendales asking me to contact them.

    I believe in all probability
    that this debt is sb, however there is the slightest chance it may not be untill november this year.

    The reason for this is I made a payment to lowell but as they had other debts of mine it could of been for one of those.

    I wonder what my best course of action should be, swould it be best I send a prove it letter to lowell and copy to rossendale putting the debt in dipute.

    The other debts are sb for definate, I just dont want this to end up with them attempting to obtain a

          If the debt is now with Rossendales, you could send a prove it letter to them ... although (personally) I would be waiting for Rossendales to get in touch first
          If they did, you could then try the cca/cpr route to see if they can produce the agreements etc... (and to delay them a little).

          I'm sure you will get other answers/advice from the Beagles too

            Totally agree Kati, don't do anything until Rossendale make themselves known.
            This is a service contract not a credit agreement, so there is no CCA '74 regulated
            agreement.
            It possible that Lowell are "farming this out" to Rossendales because they it does not have sufficient data for starting court action.
            Have you check credit reference files? If not try Noddle it's free online worth it just to check the default date that O2 entered.

              Thank you both so much.

              There is no record of this on any of my credit files. it would have wiped off years ago I believe as it defaulted around 2004.

              I will wait for rossendales to contact me and then send them a prove it letter. Although they dont have to send me a credit aggreement as it was a service contract, im assuming they would still have to send me some proof ?

                Hi, What is the payment history on this debt.
                If there has been no payment/ written acknowledgment since 2004 this statute barred since 2010???

                        I have never had a statement of account regarding this debt only letters demanding payment.

                        This letter is the first I have had in id say at least a year , maybe more.
