    I had a fine from portsmouth magistrates court I did miss a few payments had family problems but months ago I received a letter from them to say I owed even more money as they put fees on as you al know.
    when I received the letter I phoned to say it was being deducted from my benefit each week I sent the proof by recorded delivery and never heard a thing after
    until at 9 olock in the morning a rather agressive and intimidating man knocked the door for the total which is now £500 I was told that I had two hours to get the money or he was coming back
    I tried to explain that if they informed me the payments had stopped I would have sorted it,to which he.replied it's not down to him to do it
    I could not raise the money and was scared he did come back but I ignored him.
    I actually phoned the police to see what my rites were and was told it's illegal for him to be doing this I got a letter on way from the benefits agency to prove it is.getting paid and if I felt afaid I should call 999.
    it's the following morning and I am still very scared anyone got advice on what to do now

    Phone the court first thing and ask why they are sending bailiffs and adding fees whe there is an ongoing Attachment to Benefits, what is the fine amount and what is it for? Is it TV Licensing? I think Bluebottle might be a good help as this is the infamous Portsmouth court.

      no the fine was issued for compsation to marks and Spencer.
      I was paying it weekly then my.mum because ill with.cancer so.that's why they were involved in the.first place so the easy option was for it to come.straight out of my benefit money.
      And then this and it's only me.and my.sister here with my boys as my husband is in.hospital and he.was so intimidating

        Was it a CCJ as a result of an Invoice from the likes of Retail Loss Prevention, or from the magistrates in relation to part of a penalty for shoplifting. Don't worry we don't judge here, we will do our best to help. If it was a County Court Judgment, then Marstons cannot claim a right of forced entry in the same way as they can for magistrates.

          OP mentions it was a fine from Portsmouth Mags so it must have been for a criminal matter.

            it's so embarrassing lol yes it was for shop lifting he was very forcefull justthe manner of stance he knock ed at 9 olock and said he wanted the £500 at 12 o'clock which he did.but i never answersd the door was to scared he hasnt call ed my phone as of yet i wouldn't mind if i had not been paying i asked him if you knew it wasnt being paid why didn't i receive any other letters to which he answersed it is not there job to infom me i should have.known but.as it was not being paidby me how could i know he.just said not my problem

                yes they are being made I called them straight away they are sending me a letter whichwill either be here today or tomorrow.
                I did seek advice I phoned the police who to be honest said what he is doing is against the law as I should at least be given a letter to warn me and they also said any decent person would just send it bk to the court's and I will continue to pay

                  There is a basis here for formal complaints to Marstons and HMCTS which must have instructed Marstons.
                  Was this actually a fine or compensation awarded to M& S?

                    I think it might be a compensatiuon order, which is why I asked about CCJ just to make sure it was deffo mag court. If there is an ongoing attachment to benefits, then Marstons mneed to be called off and the court should be told to do it, as it is their error.

                      Yes that is exactly what the police said to me yesterday thanks everyone for the advice they definitely aint nice people and I'm not being sexist but I'm only 5 ft and he was very very forceful in his manner but if I'm honest I don't think he was expecting me to challenge it most people pay as they are scared don't get me wrong I was too but I knew he was kind of calling my bluff

                            Ok he has just been back knocked the door once and I'm guessing he left what do I do if I answer the door I'm letting him in so do I just hold out for the info needed it is making my life a living nightmare once the fine is in marstons hands can the court retract it I'm just so anno
