  • rent arrears pending court action please help

    hello all i am accompanying my brother to court in a week or so for rent arrears
    now the arrears are for abour 1200 unds (so he says) it is council property and they are taking him to court for an eviction
    is there any thing i could do to help him keep hes home and not get baillifes involved or all the other messy stuff
    all help would be muchly apprecheated also not sure this is the right area for this post

    i am hoping to go in there fully preparied for him and should he take any thing?? should he start packing?? should he maybe fill in income expenditure??

          Income and Expenditure and discussion with the council with regards making up the arrears. Prepare an offer to pay off the arrears over a certain period. Pay Rent plus say 50% on top each week until it is cleared ( of course income dependent )

          Is he not entitled to any housing benefit at all ?

            he would have been able to claim housing benifit but due to the extent the issue has got to he carnt
            i thought the same income expenditure its all down to these zero hour contracts and lack of jobs (my opinion)

              Agree, people just don't know what they have coming in so very hard to budget.

              He needs to show he is committed and is making every effort to make up the arrears and stay on top of things going forward.

              He needs to speak with the council again about housing benefit and try and make some kind of payments towards this arrears off. Is he keeping up with the standard weekly rent now ?

                Sorry this was missed Wayne is your brother on benefits? There's a chance he could get a set amount of money taken directly from his benefits to pay off his arrears - http://www.adviceguide.org.uk/wales/...nt_arrears.htm
                If you’re getting benefits

                If you’re getting certain benefits, you may be able to ask for an amount to be deducted from your payments and paid directly to your landlord. This is called a third party deduction.
                Third party deductions can be made from the following benefits:
                • Income Support
                • Pension Credit
                • Income-based Jobseeker's Allowance (JSA)
                • Income-related Employment and Support Allowance (ESA).

                Getting a third party deduction would mean your rent arrears would be paid off automatically and you would not have to worry about making extra payments to the landlord yourself.
                However, third party deductions are usually only very small amounts. Your landlord doesn’t have to accept third party deductions and can ask you for a higher rate of payment.
                He needs an up to date income/expenditure sheet, showing what he can realistically afford to pay off each week/month. And he must be willing to stick to it!

                It might also be useful for him to get in touch with Shelter (http://www.shelter.org.uk), his local MP and CAB offices to see if they can offer any support

                  ok thanks guys much apprecheated and tbh hes letting it get worse as he dosent see the point (in heas head he deffinately out evected) so hes letting it pile up and up
                  he the typr of person who dose not take advice well (bit of an idiot) lol

                    He NEEDS to show that he is able to keep up repayments or he'll not have a chance :sorry:
