    I'm trying to get a file together regarding the fictitious visits and charges from Newlyn Plc.

    I'd like to know how much you were charged and what Newlyn or your Council did about this. Could give the area in which this happened.

    I want to know with regards to Council Tax/Parking in particular.

    I have had a big problem with this Company/Council and have now been asked by the IPCC to contact the Fraud Office with more information.

    Hi,

    Are you talking about visits that enable a debt to go from the Compliance Stage to the Enforcement Stage? Beyond the Enforcement Stage you are not charged for visits per se, only for the stage so I don't see what they gain under the new system for phantom visits. I'm always very happy to see an enforcement company coming under the microscope though.

    Have the police investigated, or are they suggesting that Action Fraud is a better route for you to take?

      Is your enquiry with regards to the fees since 6th April of under the old regulations (pre 6th April)?

        The charges were applied before 25th March 2014. The first I knew of this was 2 letters posted to me (date as stated) the letters saying - Notice Prior to Removal of Goods. They never came here so charges are fictitious and fraudulent.

        The charges were applied for 2 visits on each order - i.e., £24.50 x 2 and £18.00 x 2. The costs also included a levy on a fictitious car of £235.00.

        Have paid both Orders less charges.

          Thanks for your reply really appreciate the time you take.

          Action Fraud gave me a Crime Number, after contacting them, they then gave me the telephone number of the City of London Police and said that I need to speak to the Detective in charge of this, which I need to do on Monday. So it would be the opposite of what you mention.

          I have never seen Newlyn Plc and they charged me £85.00 for visits (before April 2014). They levied a car using Google Earth. A car that belonged to the previous occupants - they never came to my house.

          What they would gain from phantom visits is money from people like myself, they tried to charge me £235.00 for the levy on the car, which, after I contacted the Council,, told me that this had been removed as a 'gesture of goodwill' and any such mention of the car has been removed from my files !

          I think this is fraud conducted on a very large scale. I need to have details of other people this has happened to.

            I'm sure what you describe above happened on a large scale with various companies before the changes in April, indeed I settled out of court over the issue of unfounded charges with my council and the enforcement company.

            Since April they have nothing to gain by making phantom visits as the charges remain the same no matter how many times they visit.

            I think you'll be able to collect cases probably prior to April, even if they've since been settled. Part of the rationale for introducing the new charging structure was to put a stop to exactly this, and to a large extent it has been successful.

            Are you saying the City of London police already have an ongoing investigation? What are you hoping to achieve looking forwards? I would imagine it would be an awareness raising for people to reclaim charges (I did it I think three years after the bailiff action had taken place); proving any sort of large scale fraud will be extremely difficult, though I don't doubt it happened.

            In terms of getting cases, I'd be inclined to Google various relevant search terms and plough the main forums. I suspect you'll turn up a good few that way.

              From what you are stating the complaint to the police is therefore that fees of £85 have been added to two accounts (as the council have removed the previous levy fee).

              The fees before 6th April provide that a bailiff could charge £24.50 for 'attending to levy' (where no levy was made) and a further similar 2nd such visit was charged at £18.00 making a total of £42.50. For this fee the bailiff merely needed to attend the premises with the intention of levying upon goods.

              I would be very surprised indeed if the police consider that this could be fraud but it may be that they have other such complaints on their files. Please do post back once you have spoken with the police as this subject is very interesting indeed.

              PS: As wombats has correctly stated, the new fee scale has hopefully removed to a large extent the previous complaints about fees and 'suspect' levies.
