  • Help! No response from CPR request and deadline looming??

    Hi,

    I've started a new thread because I'm not sure anyone has read my last couple of responses on the original thread:

    Basically, I sent a CPR request to BW Legal (solicitor for Lowell Finance) but they haven;t responded yet and the deadline is looming for my defence.

    The original claim was issued on the 6th May so the service date is 5 days after that - 11th May.

    With 28 days to respond with a defence I think I need to file something in the next day or two but what do I do??

    I really don't want to admit the debt (about £500 with added costs) but I'd rather that than a CCJ.

    Well you can settle, defend or make an application for disclosure.

    An application should work and has for some. It doesn't always work though.

    Have you identified a defence ?

    What would be a good, workable, settlement for you ?

      What is an application for disclosure?

      I want to see why they think I owe them money, as far as I was concerned I'd finished out the contract and settled all monies outstanding. The documents I requested in the CPR should tell me that.

      As the deadline is very soon, will an application for disclosure allow me the time I need to get the documents?

        It is an application to the court to order the claimant to supply the documents they intend to rely on. See this: http://www.legalbeagles.info/forums/...424#post410424

        You'd need to submit the application BEFORE the deadline to file your defence, and it will cost you £155 which you could get waived if you are on benefits or on a low income. :thumb:
