  • Advise please

I have been paying off a debt that was left by my estranged wife, and have been paying monthly since 2007.
in march this year my bank informed me someone had tried to fraudulently tried to take money from my account, they cancelled my card and issued a new one, I forgot about telling Restons the new card details and subsequently fell into arrears by two months, they made no effort to contact me and applied to the courts for a warrant which was granted giving me seven days to pay the £60 arrears plus costs which in total was £227, I have never since 2007 received a statement of account from Restons is this a legal requirement.
    thanks Abbababa

Do they already have a court order against you or was it against your ex?

The court order was against the ex, but I applied for a variation and it was granted

I think applying for a variation has kind of left you stuck with liability to the debts. you would have been better of by having not applied for variation, as then your ex would be liable.

Your best contacting restons and explain the bank cancelled your card after someone tried to fraudulent access your bank account, and you had forgotten about informing them and your quite happy to pay the arrears and costs and put it down to experience in future. Unfortunately theirs not much else you can do since they already have a warrant to enforce the remainder of the debt. Though you need to tell them your new card details and set the payments back up with them again.
