  • MKDP LLP & HSBC Court Claim

    Hi all, this is my first post on here, so apologies if I miss anything out!

    I came home today to a claim form from Northampton County Court on behalf of MKDP and HSBC.

    The particulars of claim read:

    "The claimant claims the sum of £885.95 being monies due from the Defendants to HSBC Bank Plc under a bank account facility regulated by the Consumer Credit Act 1974 and assigned to the claimant on 08/12/2011.

    The Defendants account number was xxxx. It was a term of the bank account that any debit balance would be repayable in full on demand. The defendant has failed to make payment as required by the statutory default notice served by HSBC Bank Plc.

    The claimant claims the sum of £885.95 and costs.

    The claimant has complied, as far as is necessary with the pre-action conduct practice direction."


    The debt is made entirely of bank charges, fees and interest on the charges and fees.

    This debt has bounced around a few DCA's for a while now, and it usually write to them saying that I do not acknowledge the debt, but that the amount of charges and interest come to more than then alleged debt. Them they usually refer it back to HSBC.

    I'm fairly sure that the debt is statute barred now, but I no longer have my HSBC statements.

    any advice is appreciated as I'm really panicking now

    Hi Raul

    Do you recall when you stopped using the account or have you checked when the account was defaulted on your credit file ?

    Have you entered your acknowledgment of service on the moneyclaim online site yet ? If not that needs doing then we can set about asking the claimants for more information to help you figure out the status of this debt.
