Adjusted CCJ

Hi all

I wonder if anyone can help. I had a CCJ issued by an old employer for alleged overpayment of wages. I discovered it last year on my file.
Basically my wage slips show no overpayment and I was employed on a lower rate than the advertised wage.
Armed with this i approached the LA, and all they did was agree there was a mistake.
Next thing I get is a hand amended court variation form for a lower amount.
Can they do this, surely to amend it it has to be new forms not just written over?
They are admitting no liability for the fact there was a different rate advertised, I disputed the overpayment and was still issued a CCJ. I found the payslips and if anything I am owed money from being underpaid.
It is for £600 and the accounts section no longer exists that dealt with it. Are all councils/local authorities like this.
I thought about a without prejudice letter, but after all letter writing I am loathed.

If you got a CCJ for a non-existent debt, you should have grounds to apply for set aside. You need to submit an N244 form and pay a fee of £80. You may be able to apply for remission of the court fee if you are on a low income or in receipt of certain benefits. Form ex160a provides full details.
