Hi could you give me some advice on what I should do, I went for an assessment to Mann Island in Liverpool and when I got there I was told to take a seat I waited about fifteen minutes and a lady came out and spoke to me in the waiting room and apologised to me and said that after reading my notes I did not need to attended an assessment and should have been contacted prior to attending. a few weeks later I received a phone call of a lady form the WPD saying that I was being put on to a different benefit and I would get a letter saying I had to go for a meeting but she said I would not have to go if I was not well enough as they would understand and not to worry about it but when I got the letter it was very clear that if I did not go I would not lose benefit when I attended the meeting the man said that I should have received a letter saying I had a right to a appeal I received no such letter. so I went to the C A B office and was told I had a case but its been months and they have not sent the appeal and my money stops in May.

Hi and welcome, what benefit did the lady from the DWP say you were to be put on?
If you were told you had a right to appeal then a decision was made somewhere along the line, have you had anyhting at all about this decision either by post or over the phone?

OK , here is the info on ESA https://www.gov.uk/employment-support-allowance

As you see there are two types of ESA, If you have a read through the info on there it should explain the process and you should ring up and explain that you have not had this in writing and you are worried your benefits will stop.
It sounds like the CAB think you have been placed in the wrong type of ESA but until you get it in writing we wont know that.

Hi thank you for your advice, I did receive a copy of a letter that they said had been sent out to me but never received, the letter has an advice part that says that I advice that the person meets the criteria for having limited capability for work. Prognosis says I advice that work is unlikely within 2 years. this was dated 16/04/2013 this letter has not been signed by anyone it has a Registered Nurse's name on the front of the letter it also says that I have long standing multiple physical conditions which indicate that I would continue to reach threshold under 2012 regs, don't know what that means, were do you think I should go from here.

I think all you can do is ring your local DWP ask where they are up to with your claim.
Tell them you have not had anything informing you of what benefit you are entitled to, nor have you been given any information on what you should do next if anything.
