  • Can Bryan Carter still seek CCJ if a direct debit has been agreed?

    Hi all, complete newbie here.

    I was hoping I could pick a couple of brains...

    After returning from a holiday I discovered I had received a claims form from Bryan Carter for a debt that I fully admit to. Due to the holiday I submitted my admission two days past the deadline, along with a form to set up a direct debit agreement (I believed the direct debit agreement had been posted during my holiday) Bryan Carter received my documents on 13th March (3 days after the deadline)

    I have now received the following message from Bryan Carter

    '
    - Thank you for your recent message. We can confirm we have received your completed direct debit form and monthly payments of £100 are now due to commence from the 04/04/2014. Confirmation of the arrangement has been sent to you via post. One of our telephone agents will also be in contact to discuss court action on the account. Many Thanks'


    I am going to request that Bryan Carter only communicate via post or through my Bryan Carter account, but I was wondering if they could still take me to court when a direct debt has now been set up.

    Well I received an answer today in the form of a Judgement for Claimant. Thanks to everyone who had a read, fingers crossed I'll be able to get an advance on my wages and clear the debt before the month is up, unfortunately though, the accounts manager is out of office until the 31st March.

    Please can someone advised if the month to pay is 4 weeks from the ccj issue date or 30/31 days from the issue date?
