  • Blake Lapthorn / Arrow Court Claim How Long?

    Hi everyone,

    I have an alleged outstanding debt of around £17k which will become statute barred in around 60 days. (Default date April 2008)
    Not heard anything for a long time but today I received a letter from Arrow Global informing me that they had passed the account over to Blake Lapthorn.

    I've got a feeling they will try to get a CCJ before it becomes barred.

    How long does the procedure take? Would they be able to get this to court in the next 60 days?

    FWIW - I don't own a property and I am on low income.

    Also - I have 2 defaults on my credit file for this same alleged debt. One from MBNA and another from Arrow Global

    I think you are probably spot on with your thoughts as to their intentions, and yes they could get it to court pretty sharp if they realise it is coming up on stat barred.

    What is the debt ? (loan/card etc?)

    When was the last time you made a payment or acknowledged the debt?

    When did you open the account / take out the loan ?

    Sometimes they can take a few months to default you and SB could run from the date the next payment was due after the first missed payment.

    You don't want to pre empty anything so I would just wait and see, if it does become a court claim we can deal with it then.

      Hi Amethyst,

      The alleged debt is for a credit card which was taken out in April 2005 (according to the letter I received today). I have no recollection of any payment history as this was a pretty hectic period in my life.

      I guess the best thing is to wait and see if the solicitors write to me, then take it from there. Maybe with a SAR letter?

        If they write an LBA then respond asking for documents and pointing out faults. Makes it hard to continue unless they have their ducs lined up correctly.

          if a CCJ claim is issued before the debt is SB does the SB defence come into force if the CCJ is not acknowledged of granted before then?

              Crafty move by the DCAs and their Solicitors to get them in so late gets a few people agreeing to pay

                They could even issue a summons via the Salford CCMC and then serve it, they have have done so to protect limitation so be careful.

                  As I feared I have received a letter from Blake Lapthorn giving me 14 days to respond. Whats my best course of action? I don't have 17k to pay and the default drops off my file in around 50 days.

                  I've worked hard to build my credit rating back up so I need to protect this the best I can.

                  Whats my best option?

                  What are my chances of delaying this until it becomes statute barred?

                  If I entered into a payment arrangement would the default still drop off my credit record and there be no further adverse information on this account?

                  As a side note, I have two defaults on my credit report for this account. One from the original lender and a duplicate from Arrow global.

                      If I was to enter into a payment arrangement with them, would the default still drop off my credit file or would it be changed to an 'agreement to pay'?

                      My absolute priority is to clean up my credit file. Ive had lots of defaults and a ccj recently drop off and Im beginning to see light at the end of the tunnel. I don't want to mess things up.
