  • Parking Fine and Debt Collection

    Hi,

    I was hoping someone could help me out with some information as I have been reading a lot but there's so many different interpretations of how to go about things.

    I collected my brother from the airport back in late September and after leaving the airport I parked at a road side (which I believed was outside airport grounds) for a moment as my windows were getting very steamed up and I felt it was safer to pull over for a second rather than drive unsighted. I then received a parking charge several days before I was moving house from a company who had taken a photo in a van. I did some reading and was led to understand that as it was a private company and not the local authority, they could not force this by law and most people seemed to say they just send lots of letters to scare you into paying up (practically fraud I think really). Obviously I thought since they caught me in the middle of moving I may have plausible deniability of ever receiving the letter (obviously a little fib I was hoping could buy me rights or time) should I receive any more correspondence afterwards but it has gone straight to debt collectors now having heard nothing since that one letter in October (They may have sent requests to my old place).

    The fine was £80 or £100 and now the debt collectors are trying to charge me £166. Obviously a court order would cost them £100 so I don't know if it would be worth their time unless they clocked me for sending letters, etc. I'm not sure what to do, whether I can deny any knowing of the debt and hopefully go back to dealing with the original bunch of thieves if possible i.e. the car parking company, who I reckon will be easier to work with than the debt collectors and bluntly tell them I never entered a contract as I have never signed anything and their bi laws on a signpost specifically for parking can not be read whilst driving and are therefore completely unfit for purpose. Or do I ignore it because the fee is probably not worth them pursueing due to the price of a court order? I really just don't want to pay it on principle as I feel they are just trying to take advantage of everyday people going about their business and I believe their behaviour to be totally fraudulent and immoral. It's all based on deception, intimidation and jargon they hope people will believe and I can't see the difference between this and theft really.

    I know some of these companies are often the same company posing as different parties also and I don't know if this is possibly an underhand tactic by the original parking demons? The debt collectors are Newlyn and the parking company are Vehicle Control Services Ltd. Any help would be great.

    Which airport?

    Have you checked if there are byelaws in force ?

    Debt collectors - meh.

      Hi,

      I have looked online to see if I can find anything about bye laws there and can't find much. It's Liverpool John Lennon Airport - they're in all the forums and seem to be notorious with these bullying rip off tactics however I haven't seen anyone mention it going as far as the debt collectors.

        If they don't know the driver details then they are royally screwed with PoFA given the byelaws seem to apply. Even if they know the driver they're still screwed.

          Wow, this is the sort of information I couldn't find, lol. This is some excellent ammunition. Someone on another forum has advised me to write to the debt collectors to deny the debt and send it back to VCS. I had anticipated then stating they had no authority, signs inadequate for purpose, any supposed contract should have 2 signatures, one of which is mine, etc. This is more excellent information to support though.
