    Some more ramblings of "Senile Ole Sparkie" for anyone who has had or having dealings, any letters etc etc on headed paper from SCM Solicitors, should consider and check and double check on what info I now post .
    The SRA have told me that SCM solicitors were removed from the Law Societies register in July 2011, and as far as the SRA are concerned no longer exist.
    The letters I have seen from SCM of late are signed by a David Bowden.
    David Bowden holds a practicing certificate in his own right, this gives him the following rights under the Solicitors Code of Conduct.
    1. To conduct reserved legal business as a sole practioner.
    2. To conduct reserved legal business for a recognised Law Firm
    3. To conduct reserved legal business for a recognised Limited Liability Partnership.


    SCM solicitors are no longer a recognised Law firm, so he cannot conduct reserved legal business for or on behalf of SCM.
    SCM are not a Limited Liability Partnership,so he cannot conduct reserved legal business under the excuse that he is acting for or on behalf of SCM.
    Yet he signs letters he is and does.


    At the bottom of this SCM headed paper it states that SCM are part of the Lloyds Bank Group Plc In House Hitigation Department, however on checking the details Law Societies registration for the Lloyds Bank Group Plc, it states that there are 11 solicitors in that depratment......David Bowden is not one of them.
    There is also no mention that SCM are part of that Department.


    I have spoken to the SRA about this and have been told that if what I have found out is correct and spot on it would be very serious and cause Lloyds and Black Horse some serious trouble if I made an official complaint.............but due to our appeal situation that could also have serious effect on our appeal if I made the complaint..........so at present my hands are tied.


    Once members who having bother with SCM have checked and double checked the info above and some else contacted the SRA and made the complaint.there is no telling what could happen about SCM.

      I've got a letter from SCM dated June 2013 and I've written to them since then as well. No-one has told me they don't exist.

        I love this. I've had letters from Ian Harding throughout my claim and then just recently Philippa Simmons.

          There is a solicitor called Ian Harding and he is working for Lloyds bank asset management - not at their head office.
          Can I not lodge an official complaint with Lloyds about the fact the SRA number isn't recognised and CC to Court where I have an ongoing claim?

            I would not make a complaint to Lloyds yet .......I would make an on line complaint to the Solicitors Regulatory Authority.

            I have now made one and its a pretty strong one............the more that make complaints the faster the SRA will act.........and that will cause Lloyds some serious grief.

                The Solicitors Regulatory Authority.


                Dear Sirs,
                Complaint About SCM Solicitors.


                Having had dealings in the past (2000 - 2007) with SCM then known as Sechari Clark & Mitchell (SCM) and having been the subject/victim of alleged abuse by the solictors in the employment of SCM, who were at that time stated to be the “In House Solicitors” of Black Horse Ltd.
                I will not dwell on this aspect in this my complaint, unless I am asked to provide information about this aspect.


                My complaint is about the letter sent by SCM to the solicitors xxxx xxx xxxx xxxxx who are acting for myself and my partner in an appeal before the Court of Appeal.


                On receiving this letter I immediately recognised the heading at the top of said letter, and having read the information at the bottom of the letter, this to me was incorrect was not true and totally misleading, I am informed that our solicitors on contacting them with my concerns contacted the SRA, who advised them that should I wish to make a complaint to you I should do so.


                Before submitting this complaint, I carried some research to enable me to ensure as far as I possibly could that the information contained in this complaint is factual and correct.


                On carrying out a search of The Law Societies public register, I noted that SCM/Sechari Clark & Mitchell are no longer registered and have been advised that they were removed from that register in 2011.


                I submit that to send a letter to our solicitors on such headed paper containing the information it does, is totally misleading them, in order to justify this allegation ,I would now like to refer to the information at the bottom of the letter from SCM to our Solicitors
                It states that SCM are part of the in house litigation department of Lloyds Banking Group plc.( LBG plc)


                As far as I have discovered LBG plc are registered with the Law Society as an Organisation, however Mr Bowden is not one of the 4 solicitors listed as being employed by this organization, furthermore
                LBG plc do not hold a CCA licence issued by the Office of Fair Trading
                LBG plc do not hold a Data Controllers licence issued by the Information Commissioners Office.


                The writer of the letter to our solicitors does hold a practicing certificate issued by the Law Society, it is my understanding however, this certificate authorises Mr Bowden to conduct reserved business under his own name as a sole practitioner, or for a law firm or LLP partnership he is employed by.


                Mr Bowden is employed by Lloyds TSB Asset Finance Ltd (LTAF Ltd) who are registered on the Law Societies public register. However again, LTAF Ltd do not hold a Data Controllers Licence issued by the Information Commissioners Office.
                LTAF Ltd do hold a CCA licence, number 0546899, this licence only allows them to conduct Consumer Credit Business in the following categories Consumer Credit and Credit Brokerage.
                LBAF Ltd do not hold the necessary categories required to conduct CCA activities, such as, debt adjusting, debt administration, and debt collecting, which are the main issues they are involved in with our solicitors and the Appeal Court.


                Furthermore the information on the CCA licence of LBAF Ltd shows that their registered office is 25 Gresham Street, London, EC2V 7HN.
                The Principle place of business is 25 Gresham Street, London, EC2V 7HN.
                The Address for correspondence is Tower House, Charterhall Drive, Chester, CH88 3AN.


                The trading names of LABF Ltd are stated to be
                Lloyds Bank
                Lloyds Bank Asset Finance and;
                Lloyds TSB Asset Finance


                There is no trading name of SCM Solicitors on this licence, I have discovered that the trading name of Scm is on the CCA licence of Black Horse Ltd.
                However as SCM ..Sechari Clarke & Mitchell, Scm are no longer in existence this again is further misleading information.


                Holbrook House, 116, Cockfosters Road, BARNET, Hertfordshire, EN4 0DY, United Kingdom, is shown on the CCA licence of LTAF plc as a “Historic” principle place of business no longer used principle place of business, which again is my submission another piece of misleading information.


                I therefore submit that if 1 or 2 errors had been made it could be considered of no major concern, the amount of errors and misleading information, misrepresentations of facts, disregard for rules laws and regulations on the scale
                I have alleged, should be considered enough to warrant an in depth investigation by the SRA as it could have a profound effect on our appeal hearing, furthermore it is more likely than not other persons and law firms are being unknowingly misled by the same issues I complain about.


                I have had serious concerns about the legal profession in the past this has added to my concerns and mistrust of that profession and its regulatory bodies.


                As a citizen and member of society to be a law abiding one, we must/should abide by the rules laws and regulations that govern us, the same rule should apply to solicitors, law firms and financial institutions.

                  I've also logged a complaint with the SRA.

                  SCM claim that:

                  "'SCM Solicitors' is a style used by Mr Cooper (and certain other solicitors employed within the Lloyds Banking Group) when carrying out litigation work for his employer as permitted under the guidance notes to rule 13 of the Solicitors Code of Conduct 2007."

                    The Solicitors' Code of Conduct 2007 has been replaced on the 6 October 2011 by the SRA Code of Conduct 2011 as part of the introduction of outcomes-focused regulation. (apparently)

                      The 2011 Code is stronger that the 2007 one by the looks of it, from my quick read.

                        SCM are who i'm having issues with at the moment, my letters from them say their registered office is in Edinburgh. theres an SRA number and another number but when i searched there was no result found for either one:tinysmile_aha_t:

                          Hi charleypink ...SCM were removed from the SRA register in 2011 they don't exist any more.....get your complaint in to the SRA.the more that make a complaint the better.

                            All you get back from the SRA is a 'thank you, we'll look into it' letter. Not sure how much that helps us when dealing with SCM and their antics.

                              THey do have quite a few complaints about SCM and none of these regulatory bodies tell you what they are doing .....even if they are.......and even if they are not.don't read too much into their standard reply letter.
                              Where there's a will .....there's a way...the problem we face is finding it.
