  • Claim Management Company charges

    I recently Made 2 claims for miss sold PPI with a claims management company against Lloyds Bank. On each occasion signing paperwork relating to the individual complaint. As part of the process Lloyds bank rang me to discuss the events of the selling of the original loans and the PPI products attached. During this conversation Lloyds advised me that they had looked over my history with them and that I had actually had another loan which had PPI on it which they would investigate during this process even though I had not complained about it.

    I was recently paid out on all 3 direct from Lloyds and the claims management company has sent me an invoice for all 3 even though I only signed paperwork for 2 complaints. Is this correct / legal or are they trying to collect on something they are not owed?

    Who informed the CMC about the 3rd claim the bank?
    I think it would all depend on the wording in your contract some of these CMCs can be very slippery.
    May I ask who the CMC is please?

      As Enaid said above it would depend on the contract(s) you signed. If you could either post up the contract or tell us who the CMC is we can advise.

        The CMC is Gladstone Brooke's, and yes it was the bank who informed them of the other loan. Not sure how to post a copy of the contract.

              Good evening all,

              Well now, what a coincidence EXACTLY the same has happened to me.I completed a form authorising Gladstone Brookes to pursue a claim against MBNA.

              I had already contacted the Bank of Scotland regarding a credit card held with them, and I was (and am) dealing with them direct, and have been doing so since day one with this claim against BOS.

              However, Gladstone Brookes, say that they were told (for what reason I do not know) by the BOS that they (BOS) had settled my ppi on my credit card (which is true)

              Gladstone Brookes now want 30% of the sum that BOS gave me. However they also have told me that MBNA are taking some time with my Claim.

              At no time have I authorised Gladstone Brookes to act for me (either in writing, or verbally), in connection with the Bank of Scotland.

              I have a copy of the signed agreement relating to MBNA - I have never signed anything with the for BOS!!

              I have told Gladstone Brookes to 'take a walk'.

              They tried contacting me by text today, saying, 'We understand that you have been paid by your bank,(note: they do not say which bank) and please now contact us to discuss payment of our account' - BUT yesterday, they sent me a text saying that MBNA were still taking a long time...!

              Interestingly enough, the copy form for MBNA has my signature - BUT I am certain the word 'MBNA' has been written in by someone else.

              BOS have confirmed that they gave the information about my claim to Gladstone Brookes (without my permission, in writing or otherwise) - when asked 'why?' they could not answer!!

              I smell FRAUD in a big way (being an ex PC does not help!!)

              I'll keep you posted, This, as far as I know, is not the first time that Gladstone and Co., have breached the Law.

                My advice is to make an immediate complaint to the MOJ/TS as I am sure they have broken the rules of their authorisation with the MOJ.

                  Disregarding Gladstone Brookes being dodgy here for a minute, what the blinking heck are YOU doing putting a claim through them in the first place? I'm pretty sure you've been a member here long enough to know reclaiming PPI isn't difficult, complicated or time consuming, and that CMC's are, in the main part, an utter waste of space.

                    Do you want to post up a copy of the agreement you signed and their terms and conditions. I expect you're probably on top of it already but doesn't hurt to have a second pair of eyes over things if it would help get them to burger orf.

                      When you signed the paperwork for the 2 complaints you mention, did each complaint have a different account number?

                      If so, it may well be that each document you signed was to obtain information relating to a 'specific' account number so the agreement may not cover 'any other loan with ppi' on it.

                      Double check the account numbers for the 2 complaints you did agree to and then take the 3rd account number. submit a SAR to the CMC and to the bank.

                      If it turns out you did NOT sign an individual complaint form for the 3rd ppi claim then the CMC cannot claim anything from the 3rd refund.

                      Send a SAR to your bank because unless they have a request for information for the 3rd account, signed for by you then you could possibly complain to the bank that they had no written permission to divulge information relating to the 3rd account number and may have breached the Data Protection Act in doing so when they did to the CMC.

                      Either way, you do have to pay for the other 2 accounts.

                        I don't understand the significance of this. Is this MBNA's form or GB's?

                        I can't find anything in the T&Cs on the Gladstone Brooks site that expressly allows them to charge for PPI compensation from all and any bank but you need to check the small print on your agreement.

                        In the first instance you should make a formal complaint to GB and also to BOS for passing details of your claim to GB without your consent.
