  • Claim for pub tenancy. How ever the claim is in my address! Help

    I rented a pub and tgey are claiming for diliapadations and un paid rent. I have the claim in front of me however it reads that i owe them money for un paid rent on the wrong address. They have put my home address which i own on the claim so it reads they are claiming for un paid rent on a house i own.

    Can i get out of this and how. Help.

    Could you type up the particulars of claim (leave out personal info - address /name/account ref etc)

    Were you responsible for 'dilapidations' and unpaid rent ?

      The claimant claims the sum of 4419.82 being the balance due in respect of rent/service charge in relation to 160 main street under a tenancy agreement dated 24/7/12 between the claimant and the defendant. A copy of said agreement is attached.

      Pursuant to clause c the tenant is responsible for dilapidation. Of 160 main street.

      The things wrong are: 1. The address of the property the money is owed should be 70 main street. I own outright 160 main street.

      2: it says I owe for rent and service charge however the bill they have gave me details. Rent, trade debt, sundry debt and diliapadations.

      3: I have never been given details of what diliapadations just a bill that says I owe 2010.00

      4: they are charging me in the sundry items for not buying there beer however the would not let me buy any off them.

      Hooe this is enough

          Although the court may overlook minor errors, it is diffcult to see claiming for the dilapidation of completely the wrong building as minor. Does the tenancy agreement itself give the correct address?

          Completely unacceptable. They must itemise, and preferably support this with a surveyor's report. Maintenance of the fabric is usually the responsibility of the landlord. What does the tenancy agreement say in this regard?

          4: they are charging me in the sundry items for not buying there beer however the would not let me buy any off them.
          They will find it hard to claim for a speculative loss. Can you prove that they refused your business?

            The OP states the tenancy agreement has a dilapidations clause so the Op may well be liable they must beware that the landlord may employ a surveyor and find more dilapidations to charge for,
            If it one of the big Pubcos they have to be on their toes not to get caught by them?
            Was the OP a tied tenant?

              The rent claim is correct I did owe some rent but not as much as they are saying. The tenancy agreement shows the correct address yes. The diliapadations I can not make out on the tenancy agreement as I do not know what they are charging me for. I think it is for the fixtures and fittings, which they tried to sell to me for 3500. however I did not pay anything towards this and they did not ask for anything towards them, the whole time i was there.

              I can not prove they refused me business as it was all phone calls. However they are using a system called brew lines to prove this which in twelve months was not checked or maintained.

              It is trust inns pub company.

                brew line monitor from a distance if you were buying out of tie they can if in the agreement fine you,
                I would think a talk with a Solicitor is a good move let them go through the contract

                  just looked at Trust inns website I presume you had a 1year tenancy if you signed the agreement that shows in there you were tied for some drinks and liable for repairs other than structural you need to see a solicitor pronto

                    Why can i not reply saying i dont owe any money as i own the property. At least then it will buy me some time to lookk in to it more and they will have to submit a new claim
