  • Letters to DCA's - A discussion

    Pk
So when you are talking to DCA's , creditors and debt purchasers and you write a letter asserting your rights or stating an account in unenforceable would you just state the simple reason such as This account is UE due to s78(6) CCA 1974 or do you go into more details such as this account is UE becuase x failed to comply with my lawful S78 request and did not supply the required documentation and then go on and list what they should have sent and why they can not enforce?

I know some people do not like template letters and to an extent I agree (because every case is different) so I was judt wondering what others thoughts were

I would have thought that due to the fact that they can rectify any errors, and comply by producing reconstructed documentation, it would probably be better to bring up any defects in the response once the proceedings had commenced.

Otherwise they could just say, yes you are right so here is the compliant paperwork.
