Haven't been paid yeat after having falling out.

  • Haven't been paid yeat after having falling out.

    So i worked for this barn for the summer as a groom at horse shows. The agreement was that I would work so many horse shows for X amount of money and I would get paid under the table with no contract, nothing. After having a major falling out with the barn I still not have gotten paid after a week. I am very worried I will not get paid after numerous reminders of "I look forward to receiving my payments before or on Friday" and even let her do an e-transfer.
    Is there anyway I can do something if she doesn't pay me soon?
    I am very stuck and just need advice.

      But at the end of the day i did the work and I should be getting paid as she has told me on multiple occasions that she is worried about her reputation in horse industry.

        Sorry to hear of your troubles -it sounds very unfair.

        What country are you in? We're mostly UK based, so I'm afraid it's unlikely anyone can be of much help beyond expressing sympathy.

          Getting paid 'under the table' is always a risk, unless you are working for a close friend or family member, and even then, things do go wrong.

          Not knowing about your circumstances it's hard to say anything, :noidea: your profile shows you as non-UK and UK legislation doesn't apply anywhere else, not even in other EU countries. In most countries, hiring people on a cash-in-hand basis would be an offence of some kind, and rogue employers would be concerned about being reported to the relevant authorities and this could be used to your advantage, however, you should consider your circumstances first. Many people who agree to work under this kind of informal arrangement have their own reasons, such as being an illegal immigrant or claiming state benefits intended for the unemployed, in which case bringing this up with the rogue employer may not be such a good idea. :nono:

            I tend to use the 'brown paper bag stuffed with used fivers, secreted behind the cistern in the local public toilet' method, myself.

              I noticed it says in your Profile that your Legal System is NON UK. I assume by the way you described where you worked as being a Barn instead of a Stable (Which is what we have here in the UK) that your in the US.

              Unfortunately i don't know of anyone here that has knowledge about the US employment laws. But i do no that contract Law is the very similar. So ultimately you would have to prove in court that the contract existed and that you did the work, which is harder than it sounds if the contract was verbal only.

              You should in future make sure such contracts are in writing and all pay that is owed to you is paid via proper means and not under the table.

                I live in canada. So i dont think that the legal system should be much different compared to the UK.

                  I just wanted to point out that I am legal to work in canada and I file my taxes legally every year so on my part I don't think I have done anything illegal

                    It may well be based on the UK legal system but wouldn't be identical.

                    I wasn't implying that you had, just had to post a warning because I had no idea about your particular circumstances. We are not here to judge, but we wouldn't want to suggest something that could land the OP in trouble.

                    I assume the law in Canada would also require employers to withhold tax and pay National Insurance, and the authorities would take a dim view of those who try to circumvent the requirements. You may want to remind your ex-employer of that fact. :thumb:

                      At a guess, your employer may not be so above board. I suppose what Flaming Parrot was saying above applies the world over and it's hard to get the protection of the law unless you can prove a contract. Having said that, you can prove you've done the work - do you have a legal aid or pro bono system in Canada?
