    Hope Eloise can advise me
    My OH works as a sales consultant both on and off the phone, i.e. face to face in store and on inbound calls

    The company have called all staff to call listening sessions and are grading the calls on new criteria. They have however refused to divulge what these new criteria are. They are claiming it is a random 6 calls they are listening to, however again paranoia rules
    Is this a) fair and b) legal
    The general fear seems to be that they are looking to out the longer serving and higher paid more experienced consultants , which would seem to me to be totally counter productive.

    Is it fair? That depends on your definition of fair. Is it legal? Yes. It is up to employers to determine performance issues, and the law has no comment on such matters. So there is nothing that says they must share the measures used. Until they actually do something with this, it's impossible to see whether there is legal redress. But it's an outside chance that there would be - as I said, performance is the business of the employer. You'll need to come back again if something happens.

      Thanks Eloise. He is a born worrier, makes me look calm.
      My thoughts were as you said unless they try to use the new performance measures as some sort of disciplinary tool there is not much that can be done.

        If you are correct, it's more likely to be used as a redundancy tool. That would be the cheaper option. Although they may not be that clever. Even as a disciplinary tool, I'd be hard to dispute in a proper process, but still leaves a potential for unfair dismissal. As a redundancy tool it could be nigh on impossible to even substantiate a claim.
