  • Car Battery didn't fit no refund so small claims court

    Hi,

    A rather boring dispute here; But first time I have done this. Appreciate input/comments. Facts are;

    1. Bought car battery from online retailer via battery selector which claims to give correct battery for car based on numberplate.
    2. Was delivered and found it was completely wrong type.
    3. Agreed to exchange Battery at companies nearest centre, and gave times and availability. (115 day Visa Chargeback time limit for unfit goods passes).
    4. Heard nothing from Company about exchange from that point. They refused to answer my emails demanding refund etc.. (3 months pass)
    5. Sent a email & letter of claim to their head office. Stated they own me a refund and I am keeping the goods because they have caused significant inconvenience. Will give 20 working days before filing claim.
    6. After this got a email back asking where is the battery and we can exchange it. I reply forget it and I still want my refund....!
    7. Filed claim with Money Claim Online.
    - See Attached Particulars of Claim (set them seperate).

    Had a letter I had to sign for by recorded delivery saying they will defend to the death etc... Will apply to strike my particulars of claim out, costing me £££, as they do not show the law or any relevant details, but if I give them the battery back they will refund me the cost of the battery (not court claim costs etc..).

    What do I do now?
