    Clearly I'm unhappy at work (as previous posts illustrate). I tentatively suggested to HR, that the company makes me an offer I can't refuse...not in those exact words !

    This was acknowledged by the outsourced HR Consultant by way of a "Without Prejudice" email to me. Where she asks that I come up with a solution, that she can put to the company, so that a "mutually beneficial aggreement can be sought".

    I haven't replied to that one yet...so how do I move on this, if at all. Suggestions would be appreciated.

    Legally this isn't a without prejudice communication - the term is widely misused by just about everyone. That said, it isn't really important because they aren't really saying anything other than they are prepared to discuss it.

    The trick to agreeing an offer "you can't refuse" is to make sure that it isn't one that they can refuse. Go for too much and they may close down, go for too little and they will snatch your hand off. Reviewing your previous posts, whilst there is undoubtedly an element of mutual unhappiness here, and the fact the company is even willing to consider this indicates that is the case, it seems that your approach is based more on not being happy at work than having any solid legal grounds upon which a relatively secure claim could be launched. Is that still the case?

    It would be helpful if you could provide me with the exact wording that you used in your e-mail to HR; the exact wording of what the consultant has said; and what was going through your head when you suggested this - i.e. what were you hoping for as a solution?

    I might also suggest that you upgrade your membership here to VIP (cane be done from the home page) and then ask Celestine to move this thread to a VIP area of the site, so that the information isn't put into the public domain.
