    Hi LegalBeagles, I need some advise on some contract dispute.

    I have recently taken out a contract with Safestyle Windows to supply windows and am now facing some issues after numerous dishonest practices.

    1. When signing the contract i was advised by the two salesmen that we had 14 days to cancel the contract - they stated "you have 14 days cancellation, the form says 7 but they have not updated teh form yet"
    2. The two salesmen measured up and we chose our windows which were drawn on the original contract form, they then had a surveyor call 6 days later (which we paid £60 for), who informed us that some of what they agreed was not possible and to call them to see if they could take some money off. He had us sign a survey form which he told us was to say he had completed the survey.

    They are now denying the 14day cancellation and informing us we agreed to the 7 days as we signed the contract. and that we have agreed top the changes because we signed the survey form.

    While i understand i have been naive in alot of this, do i have any legal position because they have
    1. told us it was 14 day cancellation, then setting a precident and verbal contract of 14 days
    2. Varied the contract during the survey - would i therefore have a further 7 days due to the design being different to what they had agreed?

    During all of my dealings with Safestyle their sales tactics and practices seem very underhand to me and i am now receiving upto 4 phone calls a day threatening legal action, telling me they will begin making teh windows and charge a 60% storage charge. I have been travelling for work and they have told me i am lying about being away as they "didnt hear an international ringtone"

    I have begun proceedings in the small claims court for the recovery of teh £60 which they advised me would be refunded if i cancelled. But will they also be able to force them to cancel the contract.

    Any help or guidence would be very much appreciated.

    Mispresentation of contract prior to signing, is what it is called. Write a letter to their company CEO or Managing Director informing them that the sales man committed and act of misrepresentation of contract prior to signing by misleading you into the believe that there was a 14 day cancellation period and that the contract forms had not yet been updated to show this, and that if the contract is not cancelled and all monies already refunded to you within 14 days, you will be considering legal action and may take such legal action without any futher notice. ALso include notice that you have made a formal complaint to trading standards regarding the matter.

    Send a copy of that letter to your local trading standards along with a covering letter outlining your complaint about Safestyle UK to trading standards.

      Further to above advice

      Also write to these 2 organisations which Safestyle are members of--and cherish the association with the good reputation of GGF & of course, they must also be members of FENSA which also has strict rules re the contract too--and associated general image of companies within their association

      Also -can you scan (at a high resolution) that part of the contract reverse detailing cancellations

      I believe there is a clause in there which allows either party to withdraw if the salesman has made major cock-ups when the surveyor subsequently discovers the job cannot be done as contracted fotr the price contracted

          And one of, if not the most, annoying TV adverts ever seen in the history or TV commercials!! So annoying, in fact, that i surprised some people have no idea who they are lol

              If i could stick my arm through the TV screen i would shove my fist down his throat, as that's how annoying i find the guy in that advert lol - Its been pretty much the same advert for years!

                I had Safestyle windows, they were very poorly fitted. It took them 5 years to replace the porch doors that were so badly fitted they kept snapping hinges, and a week every time the hinge snapped.

                All of the windows had huge gaps due to poor measurement and bodge fitting, and they cut throught the damp course to fit a patio door and left a cavity under the step.

                Despite many many calls and broken promises the probelms were never fixed, but after our 10 year warranty expired they constantly bombarded us with calls to have the windows replaced. We accepted an appointment with one of their salesmen, who looked around the windows, we showed him all the problems...then he said you clearly need these replacing as they are very badly fitted and ours are much better quality. Then he asked who had fitted the windows, you should have seen his face when we told him.

                Long story short, bunch of shysters who do sub standard work and promise excellent customer service but deliver nothing. If the windows are fitted right, they are ok, but if you have any problems, you may as well talk to yourself, they don't give a toss.

                Edit: My wife actually got to speak to the operations director at one point, who basically said the sales staff know absolutely nothing, and the surveyors who come to measure up are not much better. He basically said everyone who worked for him was rubbish. Nice bloke, nice company (not).
