  • old Defendant lost the plot??

    hello all,

    I successfully won a couple of County Court cases and the defendant paid up.

    Now some 2 months later the defendant is after substantial costs claiming that I should not have won as I breached and violated a contract I had with her. She is claiming that the UK court has no jurisdiction. However, she contested the claim which, I believe, is an automatic acceptance by the fact that she contested. Also, the Judge agreed that UK Jurisdiction did apply and recorded that fact.

    Is she taking the preverbial? Can I counterclaim for damages, costs and her being a royal pain in the rear?

    Is she suing you in UK court or in court overseas?
    If the judge has recorded that UK Jurisdiction applied then your defence is simply that ie that a judge has already considered this matter and the matter was resolved as she paid out which is acceptance of that fact. I'm not sure she has any recourse anymore
