  • Electrical Responsibility

    I had a electrical contracting company which I sold 3 years ago. The buyer closed the company and trannsfered existing customers to their company.
    In 1999 my company installed a lighting system into a sheltered housing scheme. There has been a incident where a worker has received a severe electric shock apparently due to live cables being left in the ceiling grid space.
    This has been investigated that this was due to our installation of the time.

    I have little reflection of this or the actual electrician who would have done the work.

    They are wanting me to acknowledge this but I have told them I am not in business anylonger and have no records relating to the installation.
    Do they or the HSE have the right to aproach me?.

    If you sold the company 3 years ago I assume within the sale all records and liabilities will have been transferred to the new buyer?

    When you were trading, did you have a duty to keep certain records of installations/jobs for a certain period of time?

    If you have no records and no recollection from memory, then I would suggest that this is all you can say to them.

    As far as I know the HSE can approach any employee/employer at any time if it involves a H&S investigation.
