  • CCJ Set aside

Had the Nat West on my back chasing a genuine claim for an overdraft which I signed a a personal guarentee for.

To cut a long story short,it ended up in court with a CCJ due to an cock up by my solicitor.

I managed to get it set aside successfuly whilst I negotiate a settlement.

Rang the court on Friday, case is not "active" as such - claiment did not file their allocation questionaire by the deadline but has been passed by the office to another judge to get further instructions so is still floating around the system.

How easily and quickly could the 3rd party "reactivate" this judgement if they wanted to? or would they need to start the whole process again?

I am negotiating with bank and their solicitor but they are threatening to request the judgement to be re issued if they dont get the Tomlin Order back on Monday but I am not yet happy about signing it because I have not had a straight answer to a question I have asked. Infact I havnt even had the courtesy of a returned phone call which was promised last week
