  • WendyB - v - Lloyds TSB Mortgage

    Well, having finally got my bum into gear, I managed to get my old account numbers, and the old mortgage account number. From what I recall, there were loads of charges on our current account around 1996-1998, and probably a shed load on the mortgage account too, given that we were almost repossessed in 1998. I seem to remember lots of threatograms from good old Sechiari, Clark and Mitchell who were TSB's in house solicitors at the time. They must have been good for at least 30 quid a pop, I should think.

    Well anyway, decided now was as good a time as any to see if LTSB would give me shedloads of money back. Should be okay with the mortgage, just about within the 12 years. May have to possibly argue Limitations with the current account, but I'll cross that bridge when I come to it, if at all. No doubt that will have to wait till the OFT case is done and dusted and the waiver removed anyway.

    I have had my SAR typed up and ready to go for 2 weeks, but as it's payday on Friday, I have just written out the cheque and will be posting it today.

      I hope you have made sure you SAR is for ALL information they hold on you from ALL business dealings, not just the normal 6 years

        But of course

        It says "this request should include data held for more than 6 years as under the DPA there is no time limit for information requested." blah blah if you don't hold info then I want to know why, blah blah confirm in writing etc etc.

          Wends I sent an SAR off to Lloyds last April and got a massive parcel of paperwork back £8.11 recorded delivery charge. Anyways life got infront of me and today I've been ploughing through and and guess what I have loads of papers of all kinds of info but NOT ONE blimmin statement, so just this minute fired off another letter asking for the missing statements of ALL dealings.

          What I'm trying to say is when you get the paperwork, check and make sure they have sent the statements too, the slippery little buggers.

            Life gets in front of me all the time Sapph, thats just life I suppose. But I will check it if and when it arrives and see what I've got, am going to cross that proverbial bridge when I come to it.......I've asked them for a list of everything, if I don't get it......I'll send the Boys round lol (or alternatively Tinkerbelle, (a.k.a. the Jack Russell masquerading as a hamster on speed). If that don't sort 'em out, nothing will!!!

              Had a letter back yesterday, saying they recieved my request and have until the 16th May to provide me with the info. OH also had a letter, saying that they've used the £10 for my info, and if he wants his info as well, then he has to fill in the form they've sent, and send another £10. Seems a bit pointless to me, as they are all joint a'cs so will get all I need in my info, so to speak. Anyway, just for clarification, I phoned the DSAR unit, who confirmed that that would indeed be the case. Only difference would be that if we had separate cards, I wouldn't get the info relating to OH's. She confirmed that all statements etc would be present no matter who applied for the info. So in the interests of saving a tenner I am going with that.
              16th May is only just over 3 weeks away, so will wait and see what the postie brings.

                Well, had a letter on Saturday re my old Classic account, saying that cos its was closed over 6 years ago (1997) they won't bother sending me the info. Unless i want it, that is! Did they not read my SAR?? I suppose it would be a battle to get the charges back now, if indeed there were any, but am going to write back and tell them I want the info anyway.

                Nothing back re the Mortgage account yet.

                  Push them for the information, after all the SAR doesn't have a time limitation on it.
                  I managed to get all of mine going back to 1992 when I opened the account.

                    thats what I'm going to do, in my SAR I put all info, not just limited to 6 years. they obviously didn't read it. But they have been very quick so far, so might not be too difficult to get it. It's the mortgage stuff i want though, there's loads of charges on that, I know. There was loads of charges on the joint account as well, but haven't had that info back yet either. that is also over 6 years so will probably be another letter from them saying they won't bother. We'll see.

                      Right then. Have written a letter to them basically saying - didn't you read my SAR? I didn't say I wanted a list of charges for the last 6 years, you numpties, I said i wanted all info you hold, whether it's over 6 years ago or not. So please send it asap.

                      My next question is, IF I do manage to get the info, which would be from 1988-1997, would I be able to claim charges (if there are any) and argue S.32, on the grounds that bank charges issue didn't come to light till 2003 or whenever, by which time my account had already been closed for over 6 years? I know I won't get a result till after the OFT case anyway, but it it worth putting in a claim, do you think?

                          I know I won't get a result till after the OFT case anyway, but it it worth putting in a claim, do you think?
                          As you know, unless you can argue severe financial hardship, the case would be stayed if entered at Court so unless you can afford to shell out on Court fees and wait then no. I would however, register your complaint with Lloyds as soon as possible so it is in the system.

                              another little gem arrived in the post from LTSB.

                              blah blah, blah. We can confirm from our records that no charges were applied to this account. Then goes on to tell me all about the test case, waiver and all that stuff.

                              How dare they just presume that the only reason I SARd them was cos I wanted to claim charges back? (Even though it was).

                              I am tempted to write back to them saying "thanks very much, but that wasn't what I asked, I've paid you a tnner for my info, I don't think a letter giving no info at all is very good value for money, can you please send what I asked for in the first place. And just cos you say there's no charges, why should I believe you"
