  • Equita Bailiff and Newham Parking tickets

    Hello Everyone,

    I have an ongoing issue with the Equita Bailiff regarding two parking tickets which happen in Newham. This has been going on over six months now and I have been sent a removal of good notice and a distress warrant on a number of occasions.

    The problems is that before it got to this stage I had rang the bailiff to negotiate payment, but they refused and demanded I paid the full amount, which at that time had amounted to £545 and £ 567 per ticket, Thats over a £1000

    It now about 6 months, they keep sending out letters I have not contacted them since , of which I am clearly, worried about, as am not sure if the money they expect me to pay is increasing. If they had agreed to my initial negotiation I would have cleared it by now.


    How do I stop the bailiff from harassing me with theses letter, This needs to end ,I would pay but would like to know how much and would like to negotiate how much I can afford to by instalment.

    Did you actually receive these parking tickets at the time?

    In the first instance I would send them a Subject Access Request letter (together with the statutory maximum £10 fee). Click this link http://www.legalbeagles.info/forums/...ad.php?t=11637 and use the letter in post #5 and remember to include a copy of the letter to Newham Council.

      I am currently pursuing a claim against CCS Enforcement Services on behalf of my Sister in Law. In her case, bailiff action has already taken place and I am now in the process of filing a Statutory Declaration form. Amy has given you a link to my thread in which Celteco has given some good advice regarding how to pursue your case and a step by step guide. There may be some steps that will not apply to you, but it will give you an idea of what to do.

      As Amy has advised, the first thing to do would be to send Equita bailiffs an SAR, they have 40 days to comply to send you all the documents relating to your case. This means they need to send you copies of all correspondence from them sent to you, a breakdown of their fees/costs etc and a copy of the Warrant of Execution. Don't forget to include the £10 fee (My SIL sent £10 cash and got it back in the end lol)
      If, like my SIL you didnt receive a Notice of Owner for either of the two parking tickets then you can file an Out of Time Statutory Declaration form which you can download from my post #37. Once you have filled this in you need to send it to the Traffic Enforcement Centre, based in Northampton. Once TEC have this then this should stop all bailiff action. (There is an advice sheet that goes with the form for you to read before you fill it in)
