  • Parking Charges -PCN

    Hi Team,

    I have been charged PCN by London Parking Solutions, and then I did IAS appeal also but they can not do anything it seems. The charge was that I parked my car in a place where they have posted the paper poster. However I did not park there, I just stopped my car there and helped my wife to get into the car (who is 9-month pregnant) and the total time I took may be less than 4 minutes. The evidence what they have given is clearly showing this. But still they do not agree and they say I need to pay. This is highly not acceptable.

    I do not have any contact number of private parking association also to talk to them. Do you know where to get them and request them? Or do I still not be considered.

    I have also told them that I have not parked the car there, I am there near to the car and I came out only to help the lady. but they seem heartless people or blind.

    the creditor says: London parking Solutions Limited

    They have charged me saying, this area can not be used, however, I showed a lot of proofs to them that that's the only area available to stop the car to pick or drop someone in that place or the main road where the construction is going on. Can you please suggest how to deal with them?

    Hi

    Have you ID'd the driver in your correspondence/appeals?

    If you were only on the parking site for a few minutes & did not leave it with the vehicle unattended, you should be able to argue a grace period.

      I have appealed and tried to contact them but no luck. Should I pay this or not ?

        Again, have you identified the driver?

        Post up the PCN and if you can get some photos of the signs and/or give a location so Google street view can look at it.

          I was the driver and I am standing near to the car only. it was here. you can see in the google maps satellite view there is a van standing in the same place. https://goo.gl/maps/HGYAhJuDyPz

            That has to be your decision.

            Personally (& knowing (allegedly) that IAS have a rep for turning down the majority of appeals), if this was a one-off event* I wouldn't pay them a dime.

            *Easier to cite grace periods for a 1-off than if there were multiple PCNs for the same site.

              I am deciding not to pay because I have a genuine reason and officially, I have not parked there like other people. And my car was not attended also. If getting out of the car to help a lady is not permitted (even though it is private parking or what so ever) then this is not correct. So I am not going to pay this and will wait for them to do next action item.

                There is no offer of a contract to park, the signs appear to be forbidding. Therefore there can be no contract so there can be no claim for breaches of that non existent contract. There are also other signs there saying do not park. Loading is not parking.
