Never heard anything after filing defence in 2016?

  • Never heard anything after filing defence in 2016?

    Hi,

    As the title says. I filed a defence against a county court claim back in 2016.

    When I login to Money Claim online, the status just says:

    Claim HistoryYour acknowledgment of service was received on 03/10/2016 at 12:02:09


    Your defence was submitted on 17/10/2016 at 12:22:42


    Your defence was received on 17/10/2016 at 14:02:13


    Will this just stay like this forever?! Doesn't it ever get thrown out, or set aside?

    It looks to me like it's "stayed" (the claimant didn't contact the court to say they wanted to continue with the claim) ... have you contacted the court to ask the status of the claim?

      Requesting a strike out is always a risk and I think has a potential cost.
      Did you request documents from the claimant and if so did they respond?
      I am guessing without further info it is difficult to judge
