  • Attachment of earnings for a debt that is paid

    My bro had a ccj, it stipulated that he must pay £50 a month.
    I paid it for him in full within 30 days.

    2 weeks later he now has an attachment of earnings order from the court for the exact same debt but from a different company.

    This company has pretty much been harassing him regarding this debt for the past 6 weeks. And even contacting his employer emailing him and constant ringing him daily. He has told them numerous times that it has already been paid.

    There is now an extra £110 charges on top of this attachment of earnings.

    Can they do this when the debt was paid a good 3 weeks before the date they applied for the attachment of earnings.

    And also can someone help us fill in the form with a defence etc? It also asks about counterclaim and I'm half considering this due to the constant harassment he has had especially counting his employer regarding a debt that doesn't stand anymore due to being paid?

      What proof have you that the CCJ was paid in full? Have you contacted the court to see if the payment was registered?

        No proof other than my bank statements. I paid via bank transfer

          So get on to the claimant and ask why they are continuing with action when you can show that the judgment was paid.

            We emailed Saturday but no reply as of yet. I don't want to ring as want everything in writing. However I still need to fill out this form and unsure how as there isn't any option really to explain that it is already paid

                  they could always ask for email proof of the phonecall (or record it themselves) couldn't they??

                    Just make the call - I can't see what can go wrong. The worst that can happen is they will say they don't have the payment and ask you to produce proof.

                      Thanks we have rang the original claimant and they are sending an email by 12 tomorrow saying that it has been paid in full so fingers crossed I can then forward this to both the people who are chasing the debt now and the court
