  • CMC Complaints to the Legal Ombudsman

    From 28 January 2015 you will be able to take your complaint about a claims management company (CMC) to the Legal Ombudsman http://www.legalombudsman.org.uk/

    The Legal Ombudsman has now published details of the scheme which operates in a similar way to the Financial Ombudsman.

    The key scheme rules are:
    • In order to take your complaint to the Legal Ombudsman you must first have complained to the CMC and given them up to 8 weeks to issue their final response. You can also take your complaint to the Legal Ombudsman if you have not received a final response within 8 weeks. You must submit your complaint to the Legal Ombudsman within 6 months of the end of the 8 week period.
    • The Legal Ombudsman will only accept complaints about service issues and not conduct issues which relate to the conditions of a firm's authorisation.
    • The Legal Ombudsman will make its decisions and recommendations on the basis of whether the service provided was fair and reasonable.
    • It has the power to require a CMC to reduce or refund fees and to award compensation where the complainant has lost out or has been badly treated.
    • Once accepted by the complainant, the decisions of the Legal Ombudsman are binding and are enforceable through the courts.
    • The Legal Ombudsman aims to resolve complaints within 3 months.
    • The scheme is free for consumers.

    They haven't got info for the public up just yet, I'd guess they will wait until the 28th.

    For now they have info for CMC's which is actually quite useful.

        The service is now live.

        Ombudsman opens door to claims management complaints
        We can accept complaints about claims management companies (CMCs) from today. This is great news for consumers. Where we find there has been poor service we have powers to order compensation, make firms reimburse costs or to provide other forms of suitable redress.
