  • Advice on Lowell & o2 Debt

    Hello, I am looking for some help with an ongoing dispute with Lowell. I have an outstanding debt of £724.32 in regards to an o2 account from 29/03/2010. Lowell have been chasing and harassing me relentlessly for last 2 months and they've now said they have passed it onto "Lowell legal department" and if the balance isn't cleared within 6 months then they will apply for a CCJ. How true is this and is there anyway that I can stop this going ahead?

    Many Thanks,

    Elliott

    Do you have a dispute on the original O2 account debt ?

    Do you know when the account defaulted or terminated ? Is the 29/3/10 date when the account was originally opened ?

    They can't 'apply for a CCJ' they can issue a county court claim which you can defend if you have cause to.

    Are Lowell trying to pressure you into making instalment payments on the debt ( £724 over 6 months = £120 a month ) that are unaffordable ?

    01/04/2014A firm must not pressurise a customer:
    1. (1) to pay a debt in one single or very few repayments or in unreasonably large amounts, when to do so would have an adverse impact on the customer's financial circumstances;
      [Note: paragraph 7.18 of ILG]
