  • Help with BW Legal Scotland/Lowell

    Hi there,

    I’m hoping I can get some advice from all you knowledgable people on here.

    We have a few debts which have ran up but thus one that’s raised its head was originally a Simply Be account which was passed over to Lowell. Had the usual threatograms from them and now it’s been transferred to BW Legal. They sent a couple of letters and now have passed it to BW Scotland.

    The letter today basically says full payment or contact required by 5th April or they may start court proceedings. Now I have looked into this and I can see lots of cases where they have went for court action, but those letters seem to be worded differently to this one. As it says we may issue proceedings not we will.

    Is this something I need to worry about or should I just keep ignoring for now? I don’t want to contact them as I’m very easily bullied by them and end up agreeing to things I can’t afford. Hence always being in trouble! The debt is for approx £1.2k and is not near being statute barred.


    Any advice would be greatly appreciated.

            It did, I've just removed the ref just in case it was identifiable xxx

            I would get a CCA request sent off to Lowell in the first instance. CCA Request

            Do you have any idea when the account was first opened?

              I think it was around 2015, the default date is Dec 2016. I’m just worried as everything I’ve read online about BW says they jump for court action no matter what, unless you can pay in full which I wish I could! Lol! I took a little hope from the wording of the letter being may instead on will. But I’m probably being rather naive with that train of thought.

                Hmmm okay, it is a pretty recent debt so it is going to be likely they can provide documents and evidence, and you are right, BW do tend to go ahead with court action if you just ignore them. To avoid the claim you could try and negotiate an affordable payment plan with them, or even a reduced full and final settlement ( sometime they will do that to save the trouble/expense of going to court and potentially coming out with a very low monthly installment figure (or nothing if they lost of course ) You can do that in writing ( preferable to phone in anycase - just ensure you mark anything WITHOUT PREJUDICE ).
