  • Argos Card

    Hi All,

I need some help with my Argos Store Card which I took out many years ago around June 2001.

Earlier this year I purchased a dishwasher on a BNPL 6 month plan. The plan was due to end on 10th July 2013. I eventually made payment in full on 9th July but the payments didn't show on account until a few days later.

Argos have since hit me with interest charges, late payment fees for every month and the balance now stands at around £95. I refuse to pay this amount since I made payment before the due date. Argos are refusing to budge and are insisting on payment.

I have been in financial difficulty also this year and wrote to them by recorded delivery recently explaining this. I also asked them to cancel the interest charges and to only communicate with me in writing. Argos have decided to ignore this letter and continue to phone me. I have a call list of around 50 or so calls in the last 3 months - I am thinking of making a harrasment claim against them.

More recently, I wrote to them requesting a copy of my CCA under section 78. No surprises that they do not have the original signed copy of the agreement but they have stated that a copy of the reconstituted agreement will suffice. They have cited Carey vs HSBC Bank 2009 as setting a precedent to support their claim that the agreement is indeed enforceable.

Any ideas on next steps is much appreciated. It annoys me that the goods have been paid for in full and all they are now chasing for is interest charges and penalty fees. I refuse to pay them and think these charges are very unfair.

Any ideas on next steps much appreciated.
