    I was shown this Enforcement Notice by a friend of mine this morning ... she's scared stiff that the bailiff is going to return and force entry to her house today
    It is addressed to both her and her ex-partner who left over a year ago (although she knows where he lives) and is the first she's known about the whole situation. It appears that all previous letters from the council and Equita regarding this were addressed to her ex, so she wouldn't have opened them, although the council were aware that her ex had left and this years CT is in her name only.

    Questions:
    I have told her to ring the council asap to see if they will get the bailiffs to put it on hold due to her only just becoming aware of the LO etc... but
    1, could she request that the enforcement is re-started (and the £235 fee removed)?
    2, she has a car (bought for £300) that she needs to get to work ... would the bailiff take it (or is it not worth bothering about)?
    3, if she gave both the council and Equita her ex's address, would they chase him for the debt instead (he didn't tell her that the CT hadn't been paid when he left)?
    4, if they won't go after her ex for the bill, will she be given a chance to arrange a payment schedule with either the council or Equita?

    1. Yes (she should demand this if she has not received any previous correspondence, including a NOE)
    2. The bailiff may clamp the car in order to force your friend into paying.
    3. Probably, if previous correspondence has been addressed to him. Reminder notices etc will have been addressed to all party's listed on the bill.
    4. Yes-She should demand this.

    Follow up the telephone call with something in writing. Ask that enforcement be suspended whilst this is being looked into. Don't be fobbed off with "it's up to the bailiffs, you have to talk to them" Kick off if they say that.

    It looks like a NOE will have been addressed to both as well. Your friend may well find that previous correspondence has been addressed to both. During the telephone conversation, she should mention that her ex-partner is not with her but she can find out where he is living. This is a clear case of joint liability where the council can go after either/or. If your friend is on speaking terms with the ex, it may well pay to talk about this and see if he'll help, rather than she sending the bailiffs to him as well.
