  • Equita Trying To Charge Now The Debit Is Clear With The Council. Do I Have To Pay?

    I'm hoping someone can help me with this. I got behind with my council tax and they handed it to Equita. I squared the £400 bill with the council but by that time it had already been handed to Equita. Now they are chasing me for £424.60 for their fees despite the bill being settled directly with the council.

    Can they do this?

    On advice from another site I sent them a letter asking for a breakdown of the charges and they came back with the following.

    Further to your recent correspondence I write to confirm the breakdown of your account.

    Debt £424 (now cleared and paid directly to the council)
    Compliance fee £75
    Enforcement fee £235

    Balance outstanding £310

    Please be advised that any costs incurred on your account are set out in the taking control of goods regulations 2014. These can be viewed via the internet.

    I can confirm that two different enforcement agents that have been allocated to your account and have attended your premises.

    I would urge you to contact our office immediately with regards to settlement.

    Can they do this and do I have to pay?

    Any help greatly received.

    If Equita has confirmed that the debt outstanding with the council is settled then any demand from Equita in my mind is just wishful thinking.

    It might be worth having the council confirm this as well.

      If Equiuta have sent a Compliance Letter then their £75 is due, if you settled with the council after this date then the council must under the 2014 Regulations forward the £75 to Equita, who if they have subsequebtly visited can add the £235 Enforcement fee, so sadly you may owe the fees.         I think that is exactly right, it is a question of timing between when you 'squared' the account with the council and when the compliance letter was issued and the date that the enforcement agents visited.

        It is a cruel system that balances the council getting their money and the enforcement agents raking in compliance and enforcement visit fees.

        But the council have an obligation to resolve the debt with you before you incur these fees so we would need to know the lengths that they have gone to ensure that has happened. Can you state exactly what prompted you to 'square this with the council' and how you actually made this payment. Was it direct with a council officer and if so, what exactly was said on completion of that payment?
