          Okay, have they cancelled the CPA ?
          https://www.stepchange.org/Portals/0...-authority.pdf - if bank haven't cancelled it send this to the bank as well as sending it to Amigo. It doesn't help this month with the money having been taken, but at least it should stop any more money being taken. I know you have opened a new account and are going to be using that, but I'd make absolutely certain that it is cancelled, and that the old account is closed off properly at £0. If anything goes wrong ( eg amigo try taking another payment ) you will have something in writing to show it was cancelled and the money should be returned

          CCA Request Letter You will need a £1 postal order or cheque to send with this one to AMIGO - although thinking on it I'm not 100% sure how it works with a guarantor - maybe [MENTION=87380]Diana M[/MENTION]; knows if the guarantor has the same rights as the actual debtor under s.78 CCA.

          Have you spoken with Stepchange or just CAB ? Stepchange are quite good helping sort out a temp DMP while you get things sorted out and getting you a hold on action. Even if you end up deciding to go down the bankruptcy route you should get a bit of a breather to consider all the options.

              so I found out the payment was taken using the long number on the front of my debit card, the bank asked me what the payment was made for. I said it was a loan payment because I was a guarantor surely they shouldn't tell me who I can and cannot pay?. like the way I took it with his repeated " well your a guarantor" and my daughter missed her payment so they took it from me. as far as I am concerned that was an unauthorized, payment without my consent. I had no idea this was going to happen they gave me no warning and left me absolutely broke, no I have £3 left!!! step change said an IVA would be best for me. I didn't agree I was embarrassed and so begrudging that my finances were gone through. and was told what I can and can't have from my earned money to pay someone else's debt is that bad of me

                Mike, with all due respect do you know what a LLP is? It is a limited liability partnership and can include all sorts of business types.
                If you mean a solicitor, I am not sure if they can give debt advice because they may not have an FCA licence. CAB can i think because they have a licence as can national debt line and stepchange and the like.

                The rest of us just give opinions - I think we all know solicitors rarely give direct answers or guarantees. Fast track to a complaint if they did.

                  Not sure an IVA is best, the forum sees quite a few failed with awful consequences. IMO IVAs make lots of people lots of money except the debtors and creditors.

                  Was this month the first month your daughter missed payments?
                  I think many of us were thinking it was an ongoing problem.

                  As far as I know as a guarantor your name is on the credit agreement and you can make cca requests
                  I would be getting those off ASAP to all the creditors and contacting the banks to revoke CPAs

                    she's a week late with the payment, apparently, she rang them and asked for a date change they wouldn't allow it the payment was due 25th she didn't pay it so they came to me she said" she's trying to sort it out. mean time too late for me cos they have taken the money. she txt me when I told her she needs to get me that money back

                        Make sure you also tell the bank.

                        Let's hope your daughter can sort things out, even if not full payments at the mo at least substantial ones.

                          Iv been to hell and half way back past few days. I know there are guests who read these posts. and notice there are very helpful people on here. if anyone is even thinking about been guarantor for a friend, family, whoever! please DON'T do it. amigo is the scrapings of the barrel. and now obvious to me that they only help"(ha) people who can't get loans from normal routes. with decent interest rates. all payday loans and these kinda loan dealers should be wiped off the face of the earth. I know we didn't have to go to them.it's my fault going in blind! but I really did go in blind, and I'm not out the other side yet. all this mess still has a long way to go.I decided I'm not taking the IVA path.it's either ignore them bury my head in the sand let them take me to court then, I can explain my actions and face the consequences or bankruptcy.

                              No matter what Sharron, you are not stupid.

                              You hold your head up Mama and be proud that you love you kids so much you would do this for them, and that is nothing to be ashamed of!!

                              Burying your head in the sand isn't the best option tbh, I would be speaking to your daughter on a monthly basis, reminding her that she has to pay this debt even if it is token payments.

                                [MENTION=68165]sharron22[/MENTION] - don't go ignoring and waiting for things to tumble in on top of you, get a handle now on what the position is and see what action you can be taking to prevent future action. You have changed your bank account and cancelled the DD's etc on the other one, so you are back in control and can look at getting into a DMP or something to give you some space if necessary. You know your priority is your Rent, Co Tax etc.

                                First, lets just check the overall situation a bit - there's 3 debts you have taken on ( responsibility for as in your name or you're a guarantor ) for daughter - which add up to £35k? Is that right?

                                Amigo £9k - your daughter is making the payments of £296 a month, she missed a payment 6 months ago and this month, and Amigo took the money from you as guarantor. She isn't in arrears ( because you made the payment ) and is trying to pay you this week for that missed one? ... however you are worried going forward as if daughter misses another payment/s it wipes you out. You've cancelled DD and CPA and sent CCA request to check terms.

                                Tesco Loan for a car - in your name - how much is that for ? and what's the exact status of the loan now? Is your daughter still making the payments on it ? any arrears ?

                                Currys - loan or store card ? for kids Christmas presents - how much is that for and what's the current status ?

                                Couple other little bits - MBNA card with capquest now - £1200 (statute barred) ? and a catalogue debt £200 ? of your daughters ( did that get sorted finally ?)
