    Firstly, thanks for the input above, very useful.

    Finally got hold of all info from HSBC, lots in there but no signed loan document. Robinson Way however have provided a copy of a signed agreement.

    As I understand now the best course of action is to liaise with them in writing over settlement amount or otherwise?

      That's curious.

      How can Robinson Way have a copy of a signed agreement if it doesn't exist in HSBC's files?

      You may need to run forensics over the document.

        That was my first thought - their copy looks as expected but the mound of document from HSBC we received had plenty of details and account information around the loan but no signed copy of the agreement.

          I know that when I sent SAR's ( to different companies) I did get back what they held on file as my agreement

            Just an update on this.

            - HSBC produced everything except the signed agreement for the debt (2007)
            - Showed the debt being sold from HSBC to a debt collector in 2013 but didn't specify who (expect MKDP)
            - Robinson Way since produced a copy of signed page, not the full agreement
            - RW also provided an assignment that MKDP sold it to Hoist who they are acting for and note that there's a previous CCJ from when was with MKDP
            - RW asked for statement of income etc; the family member is a stay at home mother
            - RW threatening to go back to courts now on it and asked me to send all documents I have if I feel there's are incorrect


            Any advice on next steps? It's not statute barred for another year from what I can see (Dec 2012 last payment to HSBC). A debt is a debt but feels such a broken process with them if there's a way to circumvent or do this properly would help.
