    Hello all, I was referred here by ploddertom, a CAG vet.

    Im not a consumer rights activist type of bloke, but I do have an interest in the bailiff industry going back to 2006.

    I'm from West London but currently work in Dubai.

    I had a flat in Surrey which we used for our airport turnarounds, we are both pilots as you might tell from my name, with different companies, me Emirates, she easyJet.

    My bailiff knowledge started on a rare occasion we both overnighted in Surrey when I returned the UK during the night, and my partner was getting ready for her early Gatwick start. At 6am, a dirty looking guy at the door, we didnt bother answering because he looked like a lost fruitcake, so he decided to go round the back, climb the fire escape and prise open the back door.

    My partner was hospitalised with a broken foot when he pushed the door over it. Damage to property and he goes on about owing £300 for a parking ticket. Police called on 999 who said he is a bailiff and its all a civil matter.

    I dragged it through the courts, which is where I gained much of my knowledge on bailiffs. The result.

    1. Personal injury claim £83,000 - partner was grounded for 7 months, she needs the use of both feet to fly an Airbus A319

    2. Damage to my flat £1600 settled by the council

    3. Council had to refund all parking tickets it had issued in the last 6 years because they were not compliant with the law. (thats what happens when they do not cooperate with me, I start talking to the press) - refunds paid about £110K.

    4. I made a complaint against the police officer to a magistrate for corrution, by saying bailiff crime is a civil matter. His force retracted the civil matter comment in return for me dropping my complaint. Crime investigated. Bailiff arrested but given a police caution for offences under the 1968 Theft Act, Criminal Damage Act and the Offences Against the Person Act.

    5. Bailiff company lost its Credit license after I complained about fitness to hold one. I caught them charging credit card fees contrary to their Merchant Service Agreement and placing a cardholder under duress to obtain a credit money transfer. Bailiff company dissolved and reformed as Marston, same game and same players just a new name, plus a new director on the board to put up his Surrey mansion as colateral for reinstatement of its credit license.

    The bailiffs certificate was out of date, and consequentially, he was uninsured. This also gave rise to a further complaint against the police officers for professional incompetence. At the scene, they failed to see that the bailiff credentials had expired. The IPCC recommended the officers undergo some re-training.

    I discovered CAG, and helped others with bailiff troubles, but discontinued after finding the forums becoming rather over-moderated. Too many of them in your face, some with egos the size of a small planet.

    As well as a passion for flying, I enjoy aviation photography and am never far from the worlds airshows. I was a first offficer with Britannia (now thomsonfly) on Boeing 767's, and before that, the Royal Navy. Today, I also work unpaid helping others from the low-income communities and, the same, but in an unspecified official capacity (but not a lawyer).

      Welcome on board and i hope you have a pleasant flight with us here at legal beagles airlines. Though watch out for some whom may try to disrupt the flight (no named mentioned though am sure member no who i mean).

      Well done with your claim against the baliff its a shame your wife had to suffer so much as a result of their criminal actions. Also a shame they regrouped as Marstons too as we are all familar with them.

      I totally agree with your comments about CAG and its moderators. They wrongly accused me of making libellous comments and even named my username in reference to the posts that were removed. Haven't been back their since and am still waiting for there response to my letter before action boy are they in for a shock over the next 12-18 months lol.

        WOW! Im not sure if I would be bothered to deal with CAG by letter over a dispute with a moderator, I'd just go elsewhere.

        However, any webmaster should consider Godfrey vs Demon Internet Ltd when deciding whether a forum post is appropriate.

        At the request of an old friend, I am looking into getting the definitive answer as to whether or not, bailiffs collecting court fines can charge fees to the defendant. I have a debate thread on CAG at the moment.

        A future enquiry will determine whether or not a defendant can decline payment of Reg 13 misc fees charged by an HCEO. Currently this is the blank-cheque clause being exploited, which is netting enforcement companies thousands per case. That is for another day.

          Oh trust me the letter before action is purely informing them if they do not repond or refuse to resolve the issue amicable and satisfactory i.e. issue a public apology and reinstatement of removed posts and removal of account restrictions then legal action will follow. As yet they have not responded, so legal action is now the likely next step.

          I truely support you stance on the charging of fees by HCEO under reg 13 too as it is purely day light robbery. Keep us all updated on that won't you as no doubt it will be very interesting.

            Im not a legal expert, but I dont think there is any grounds for proceedings to get posts reinstated and usernames returned.

            As far as CAG is concerned, its their server, they can do what they want with it.

            You sign up a new name, but remember to reboot your modem/router to renew your public IP number, and create a new desktop in Windows. Thats stops administrators linking new forum accounts to your old one.

            As for reg 13, I havnt fully researched it yet, but my thinking is an amendment bill limiting HCEO misc costs and replacing it with actual costs. None of this 'resonable' costs, its badly written legislation, it encourages exploitaiton and litigation. The only winners are solicitors fighting on each side. Thats the tough bit, passing legislation that is drafted my lawyers, that does not work in their pockets favour.

            The UK passes strict regulation to protect consumers from a faulty dishwasher, or a dodgy window salesman, but being defrauded by an HCEO of thousands in bogus costs, the consumer has no protection at all.

            There are lots of other gripes, those for another day.

                  Ive tried being an armchair pilot, but the MS flight sim verson of a 77W is a harder animal than a real one.

                        Hi Happy Contrails, I'm one of those who deals with issues the other side of the fd door. It's a jungle out here and bailiff related problems are on the increase with some local authorities constantly calling in their money in questionable ways. I'm finding the forum a powerful tool and due to a few less 330's I've got quite a bit of spare time on my hands over the winter period. I'm not enjoying the income side of things at this time but what I've learnt here has been invaluable. Shared knowledge is very powerful.
