  • Hello everyone. Advice needed re debt collectors chasing bereaved family.

    I need to put a health warning at the start that I am not very technically savvy . I am a pensioner and only have an iPad to do these sort of things.
    We have had a recent bereavement in the family and out of the blue two debt recovery companies are trying to chase for debt which none of the deceased's family knew anything about . Indeed it looks as both of the are chasing the same debt.
    Which is the best forum to get advice from please ? Thank you in anticipation.

      Have the debt collectors contacted you by letter, if so can you post up the letters (suitably redacted) so the beagles can give you more advice. If you are unsure how to do this, are you able to just take photographs of them with the iPad & send to kati@legalbeaglesgroup.com Kati who will do it for you. Add the title of this thread as the subject & add your username
      Sorry i'm just thinking out loud, it might be irrelevant, I am not employed in anyway in the legal profession, please ensure you research any advice I give before using it I have been known to be wrong on multiple occasions.

        Do you know what the debts are ? are they things like credit cards / loans etc or is it something like benefit overpayment / hmrc etc ?

          Two very simple question

          Was there any estate left after paying priority debts such as funeral costs and reasonable expenses. If there wasn't then you could simply write to the DCA's saying there was no estate.

          Obviously it all depends on the nature of the debt and if there was an estate

          Do the DCA's know the family member is deceased?

            ...and they should be contacting the deceased's personal representative, only to register the debt with him/her whilst the estate is settled.
