  • Dwp Funeral payments maladministration ombudmsan decline

    My Father in law passed away and my mother in law paid for the funeral with part funeral benefit. Nearly 4 months later she recieved nasty phone calls and letters and was requested to attend tribual at the age of 83 undergoing terminal cancer treatment. My MP has helped escalate through ICE and has been upheld and now the ombudsman decline!!!!!!

    Can anyone help me with the above. We have been through hell to fail at the last fence for no reason. They say we cant take it to court. I have asked for all the information they have based the decision on and a copy of letter and call where they have apologised -They havent !

        Thank you very much. After dealing with ombudsman for 17 years in my employment and reviewing the cases and reading their letter it seems they do not even have a reason to say Ive no case. I will refer peridot

          Hi Chocolate lover,
          I'm sorry this isn't something I am familiar with either I'm afraid. I am assuming you have contacted your MP to instigate the ombudsman process. I'm not sure if this link would be helpful:-https://www.resolver.co.uk/consumer-rights/mps-dwp-complaint-complaints There may be someone else along in a bit who may have some better ideas.

              You asked for "all the information they have based the decision on and a copy of letter and call where they have apologised " and they declined to give it to you?
              What form did your request take?
              Was it a formal "subject access request" sent to the data protection Officer, or just a phone call to the local office wallah?
              Here is what you should have sent https://www.gov.uk/government/public...al-information

              Did your MP raise the matter with the Parliamentary & Health Service Ombudsman ? (as per Peridot post 5)


              Has there been a tribunal hearing?

              I doubt in this case you could sue the DWP (or secretary of state) as there does not appear to have been any offence.
              If the tribunal has found against your MiL I think your only course of action is for a judicial review that the decision is one which no reasonable decision maker could have come to.
              Application needs to be made wihin 3 months of the Tribunal Finding..
