  • Covenant on neighbouring land

    The land we are buying from the neighbours (or hope to - still going through) has a covenant on it which our title has control over.

    We have drafted an agreement for the sale of it and they have asked that we keep the covenant on the land

    Our house originally owned the land and sold it off years ago

    When they sold the land our house put the covenant onto the land

    “Not to erect or permit to be erected any building or structure upon the area of land area marked B or from further developing the land without first obtaining the written consent of the transferor or transferor successors in title “

    Surely this means we can give ourselves permission to build if we wish?

    Help please! It some stage we would ideally like to build on this land!
