    Good evening all. I was hoping for a little advice on an insurance payout issue.
    Basically there was a fatal car accident that killed DSD's dad 2 years ago. The car insurance paid out a sum in death plus the market value of car.
    Now it gets a little complex. DSD grandma took care of the insurance process & it was agreed between DSD's mum & grandma that the sum on death will go into a bank account for DSD. The payout for value of car (which was registered to DSD dad but owned by DSD mum as she paid for the car) should of been paid to DSD mum. But grandma put the entire amount into the bank account. Mum dosent have access to the bank account as grandma is a control freak.
    Car was bought for cash but mum does have bank statement showing withdrawal for car purchase.
    I believe the bank account may be a trust account connected to grandma's bank account
    Our question is, can mum legally (through the small claims court) get the money she is intitled to for the market value of the car.
    We have our reasons for going down this route.
