  • GMAC Voluntary Termination - VAP Payment ?

    Hi,

    I Recently VT'd my corsa with GMAC after paying over 50%, no issues really handing car back apart from their attempt to charge £85 to collect which i said no too, they relented as a sign of goodwill ! i.e 'OK we tried and failed on that one'

    The Collection company came and got the car and inspected it, no faults perfect condition nothing to pay. Great i though all sorted.

    Then i had a phone call stating that i still owed £330 ? I Quiered this and asked them to email be a summary of what this was for so i had a record, apparently it is called a VAP payment (anyone know what this stands for) when i quiered further they say that my GAP and warranty was seperate and paid directly to vauxhall at the beginning of my aggreement. and was deducted fmonthly from my DD of £205.

    Here's where it gets strange, My monthly DD was £246 for a start not £205 and the paperwork i have shows the Vehicle Price + GAP + Warranty, all included in the final figure that i was financing ? Can't find any mention in any of my paperwork that says my finance was split to pay for the CAR etc etc in this way.

    Can i refuse to pay this "additional" payment as i have payed over half the total amount that included these products ?

      Hello

      I assume GMAC refer to VAP as a "Value Added Product" e.g. the GAP, warranty etc.

      Generally, these types of products are bolted on to the total credit that is being offered to you which generally forms part of the total price payable under the agreement. So whilst they may be separate products they would have been bundled into the total price which also collects interest on those products and you pay one agreed monthly sum which covers this.

      Obviously you will need to check your paperwork but if you haven't got separate direct debits for these VAPs then I can't see how they can claim that they are separate and are owed when they fall within the total price payable and therefore only liable for 50% of that total amount.

        Thanks R0b, that's what i thought, definetly only had 1 DD coming out of my account and the statements i've been getting for the past 2+years show that i was paying the figure i mentioned and can't find any mention of this in my papaerwork

        I've emailed the woman at GMAC back stating this, and asking them to show me where this is in my contract, Will see what happens.

          R0b So i had a call today (nearly 3 months after handing car back) from a very rude lady at GMAX Finance saying my complaint had been denied and threatening to take me to court if i didn't pay !

          I have had no correspondence from them since i filed the complaint against this additional payment, and she kept going round in circles saying that the VAP payment had been paid at the start of the agreement separately to the cost of the car and was not included in the finance, which i stated several times that my paperwork says the opposite, She again stated if it was not paid in 7/10days they would instruct there solicitors to recover the money in court!

          I have asked for the response via letter to state why and how they come to the decision of denying my complaint, so see if they actually bother to send me anything in writing.

          On a side note my Credit Report now lists my agreement with GMAX (Vauxhall Finance) Closed since 2018

          Do i have another course of action to take, as feel they are just trying to get extra money now, and after this lady's attitude with me, loathed to pay them anything extra.
