  • Ownership query

About 7 months ago I was asked by a UK Engineering company to design an industrial mixing machine which included all the fabrication drawings, I submitted a quotation and received an order to complete the work.

The work was completed and for the last few months the company was manufacturing the mixing machine, for a third party. During this time they went into administration and the liquidators sold off all the assets. Because the 3rd party had paid stage payments they were allowed to collect the parts of the mixer that had been made.

To date the 3rd party has found another fabricator to complete the works, but in order to do so require a complete set of drawings.

The question who is the owner of these drawings, the 3rd party thinks they are there’s, but I never got paid for my order. The original company kept fobbing me off until they went into liquidation. Hence I believe I’m still the owner of the drawings, so should be in my rights to sell them on.

    Hi and welcome

It seems to me that as you supplied the drawings under a contract you were a creditor of that company when it went into liquidation, and the drawings were one of the assets of that company.
    Who currently has the ;plans?
Did the liquidators actually include the drawings and sell them on to the third party who now has them, or were the 3rd party already in possession of the drawings and just kept them without informing the liquidators?
Did you make a claim for your outstanding payment to the liquidators ?
