    As banks wait for the outcome of a legal test case to determine the fairness of overdraft
    charges, reclaiming bank charges is currently on hold for most people. However, if you can prove that you are in financial hardship, your bank should consider your claim now.
    Hardship is defined as being unable to meet priority financial commitments; these are things like utility bills, rent, council tax, and food. When contacting your bank, you should also highlight any change in lifestyle such as relationship breakdown, death of a partner or starting a lower paid job.
    How to claim back bank charges if you are in financial hardship


    Write to the bank asking them for a list of charges, then write to them asking them to refund your charges now, rather than waiting until the end of the test case. Download our template letter.
    Each bank has different rules on how they look at hardship claims. Some may consider ALL bank charges (going back up to six years, the maximum time period allowed), but others will only look at charges within a specified period of 'hardship'.
    If you are in hardship and reclaiming your charges now, banks MUST NOT offer you a 'full and final settlement', as you may be entitled to claim more once the test case has been decided.
    Your bank has eight weeks to resolve your complaint. If you're unhappy with their response, contact the Financial Ombudsman Service who will look at your claim and decide whether the bank should award you some or all of your charges.

                    I also emailed one of the researchers for the program to say thanks to them for airing the program. Having now watched it there were some things I would have liked doing better but I thought the program was better than I thought. Slap that man on the use of the words "penalty charges"

                        I will also start to work in next week or so on the producers of Live on Five to do a piece on Claims Management Companies as Ian Wright who is one of the presenters is a client at work. As we all know it is not down to the actual presenters and if it were I could speak to him directly so I will talk to my boss nicely to give me the name of the person who we should contact.
