  • Pecuniary Legacy query

    Hello,

    I have been left a 'Gift' (Pecuniary Legacy) in my Dad's (stepdad) Will, as well as a 4th share in his Estate with my siblings (his other step children).
    My sister is stating that I should share the $ amount that our mum left to our stepdad when she passed. (which is included in the gift)

    My questions to you are:
    * can anyone contest a 'gift'?
    * can any of my siblings lay claim to the portion of the money my mum left to my dad?

    Hi and welcome to LegalBeagles.

    Sorry to hear of your recent bereavment, and the upset that appears to be brewing over your late Father's will.

    The terms of any will can be disputed,but whether the dispute is upheld or not is a different matter.
    I would think that if the will has been drawn up correctly your Father's wishes will hold firm.
    Your individual legacy and residual legacy are yours.
    Are you the executor? If not obtain a copy of the will to examine its terms. Also request a copy of the estate accounts from the executor to ensure there have been no shenanigans.
    Unfortunately there's nothing like a death and a will to start family feuds.
